George Zimmerman Team Begins Offense

To date, the public has only seen George Zimmerman's legal team has been playing defense - fighting for bond and against the negative perceptions of their client created by the selective discovery released and the Martin family and their media team of lawyers and consultants.

Yesterday, that began to change. Mark O'Mara filed a notice of hearing for subpoenas he wants issued for Trayvon Martin and his phone friend "DeeDee"'s cell phone accounts for the period of 1/1/12 to 6/1/12, and for their Facebook and Twitter accounts,.

In another motion, Mark O'Mara says it wants the original recordings of Witness 9, George's cousin, brought to court because despite repeated requests, it may not have received accurate and audible copies and it wants to make sure what was submitted to the court at the bond hearing is the same as what they received. In another motion, O'Mara asks to continue the October 17, docket sounding because discovery is not complete. The Defense will be taking 50 to 75 depositions.

Zimmerman's family has also stepped up their media presence. Zimmerman's brother Robert has been appearing on Fox News, and last night, Robert and their mother Gladys Zimmerman appeared on the Piers Morgan show.

Interestingly, last night Martin family lawyer Benjamin Trump issued a statement saying that on his advice, Trayvon Martin's parents "deactivated" his social media accounts to preserve his reputation. According to Twitter's privacy policy, it begins deleting information stored on deactivated Twitter accounts within 30 days. On April 2, 2012, Trayvon's mother told the State's Attorney that she was aware of Trayvon's Facebook account, but not his Twitter account (Page 37 of the 284 page discovery release.)

there is no dropping of charges or even lesser changes.

Corey has too much at stake regading being the next nifong.

I think that train left the station, unless the judge steps in to save the moron prosector's hide. That is a distinct possibility and will depend on if the judge and prosector are friendly and have the same political friends (but different political ambitions). Otherwise, the judge will just let the moron prosecutor twist in the wind and laugh to himself.

Oh I’m sure they will be — but I hope not before all those on the prosecution side are exposed for evidence tampering, and obstruction.

The doctrine of “spoliation” says that when evidence is no longer available, it is presumed to have been harmful to the party last in control of it. In this case, the Martins may have screwed the pooch.

As it happens, last March, I found a Google cache (gone now) of Trayvon Martin's Twitter account, @NO_LIMIT_NIGGA.

Martin used this photo as his Twitter page background:

That's the mugshot of rapper Corey Miller, aka C-Murder, who is doing life without parole for beating up and shooting to death 16-year-old Steve Thomas in 2002 at a night club in Harvey, Louisiana. Quite the role model for an up and coming wannabe gang banger, don't you think?

Martin's Twitter account handle was NO_LIMIT_NIGGA. Miller's record company was No Limit Records. Martin listed his name as SLIMM, his location as YO HOE CRIB, and his favorite website as LIES.COM. Dude liked caps!

And it is for sure the right guy's account. It contained a birthday greeting from the lovely and charming EatYhurBrainz, aka Kia (whose ballistic background pic would have pleased Doc Edgerton). Kia turns out to attend the same high school as Martin. And her greeting would have been sent on the evening of 5 February. Martin was born on 5 February 1995.

spoiliation of evidence can be a crime.

it IS a bar santionable offense.

if a lawyer is attempting destruction of evidence then he is a fool.

The Martins may be double losers here. Not only will it look bad if they deleted the account and didn’t save his tweets, but the Court may then allow evidence from secondary sources like the Daily Caller that did save his tweets.

Based on the evidence made public so far, there is no case.

On the phones, since O'Mara didn't release the actual subpoenas he wants issued, it's unknown whether he is asking for specific phone numbers or making a general request. Does he not believe that this phone, found at the scene, is the phone that Trayvon was using that night? Since he already has records provided by the state for one phone purportedly used by Trayvon and one by Dee Dee (also see here) although for a shorter period of time, he may be after different phones either or both used. Or, he may just be trying to rule out that either had more than one phone.

Hmmmmmm!!!! What's under that rock may be interesting.

Did he advise them to lie about it to the State's Attorney as well:

I don’t think so. They will make a full court press and put responsibility of the decision in the hands of the jury. That way the rioters won’t be targetting them.

However else you read the significance, certainly sounds like they knew the facebook and twitter would cast doubt on Trayvon’s reputation.

Thing I most hate is the media treats the Martin lawyer as if he is counseling an aggrieved family and seeking justice. In fact he is a blood sucking leech out to maximize a monetary recovery and line his own pockets. He is not even remotely interested in the pursuit of justice here, and his role in the Zimmerman criminal trial is pure evil.
