I am finally home after a day of Christmas shopping that started with purchasing a revolver and a pistol for my two daughters at Shyda's Gun Shop. My purchase actually started three weeks ago when my background check was put on hold by the State Police. There was no reason given. I've never been in trouble with the law, and I have made multiple gun purchases this past year without any problems with a background check.
Yesterday, I received a call from the gun shop informing me that my background check was approved. Fortunately I had already planned to take off work today and I arrived at the gun shop shortly after 10 am. The parking lot was full and the store was packed. I didn't have to wait in line, since the two handguns were held for me until my background check cleared. I have to say that Shyda's has great customer service.
Guns were flying off the shelves and there is a huge list of back orders on many models. What was probably most interesting was to wait to get background checks. They said it was taking 20 to 40 minutes to get a call through to the State Police for background checks. I stood at the counter and heard busy signal after busy signal as they redialed to get a call through. This must mean than many gun stores in PA were doing a lot of business.
The NICS check is confirm/hold/deny...if not answered in 72 hrs, it’s supposed to be deemed as granted.
And what dealer will transfer the gun after 72 hours if they haven’t received approval? Think there is any liability involved?
In certain places there’s both a federal and state background check on handguns.
In New Mexico it’s the NICS and done. About 5 minutes before all this craziness.
Made the rounds of several shops today, it looked like locusts had been through them. And it’s not just AR’s and such, people are buying anything.
One place that buys ammo by the pallet load had no .223 and no .308, and was limiting 9mm, .40 and .45 to 2 boxes per customer.
not sure on question 2, nor is he since I don't go committing crimes.
The rule is that after 3 working days with no answer, a delay can go through.

Firearms Freedom Act (Signed into law in 2010 in 8 states)
Originally introduced and passed in Montana, the FFA declares that any firearms made and retained in-state are beyond the authority of Congress under its constitutional power to regulate commerce among the states. The FFA is primarily a Tenth Amendment challenge to the powers of Congress under the commerce clause, with firearms as the object.
The Intrastate Commerce Act does the same thing as the FFA in regards to firearms, but also expands the principle to all products grown, produced, and manufactured within the state.

I used to get a “hold” every time they ran one on me. They never rejected me but I always had to wait the three days and then go back to pick up the gun.
Last year I got my concealed carry permit so I can now purchase on the spot with no background check required. If a store (like Dunhams Sports) tells me that they know it’s state law but store policy requires they do a background check anyway I tell them thanks but no thanks I’ll do business elsewhere.
I can relate to the common name problem.
Never really had a problem ever.
Believe me, I'm all for walking in and walking out without a hassle. But I'm curious - if they find something bad and refuse the sale, isn't that keeping that weapon out of the hands of a bad guy or lunatic? Do you have some other source of info that says the checks aren't effective?
The background check for me only took about an hour on Wednesday at a local gun shop.
Was at a shop in Mechanicsburg yesterday. Eight people in line at a postage stamp of a gun shop.
I took care of all the items on my ammo & mags list on November 10th.
Buy the gun
Take the receipt to the PDHQ in Mineola, register it.
Take the PD marked receipt back to get the gun.
Take the gun to PDHQ to verify sn.
Not the same for rifles, those you just buy after the call to the feds and walk out with.

And what in the name of John Moses Browning is the STATE POLICE holding up your 2nd Amendment rights for? The Brady "National" Instant Background Check was supposed to be a Federal function. Not that I wanted it to start with.
Here in NC, if you have a Conceal Carry license, it's cash and carry, baby.
Every time I buy, the purchase goes through fast, and the clerk says boy the FBI must love you. LOL.

I'd like to know that too. PA doesn't use NICS, only 30 states do. Knowing how things "need" to be done in PA, a separate bureaucracy is needed to do background checks. In PA, it is called PICS. Looking at the PICS website, it says about 60% of people receive their approval in a few minutes. That has always been the case with me until this most recent purchase.
I have a CCL in PA, but it doesn't help me with background checks. CCL or what we call LTCF is another wonderful bureaucracy that varies in each of the 67 counties here. If I recall correctly, in my county it takes about two weeks to get a LTCF. There are other counties in PA that take a half hour. And then there is Philadelphia county that makes it much more difficult even though PA is a shall issue state.
For the most part, gun laws in PA are much better than other northeastern states. There are no restrictions on the weapons you can buy, other than federal. It is simple as walking into a store, getting the PICS background check, and paying for the purchase. Of course, I am of the mind set that the government shouldn't be involved in anything related to firearms and weapons in general. The 2nd Amendment has no buts in it.
