SMS containing the word 'divorce' is valid: Dubais Department of Islamic Affairs and Charitable Activities An SMS message sent by a husband to his wife containing the word divorce is enough to make the divorce valid, according to a fatwa of Dubais Department of Islamic Affairs and Charitable Activities.
A report in the Arabic newspaper Al Ittihad said the fatwa came in response to an enquiry by man who wanted to know whether the SMS message he had sent to his wife telling her that he was divorcing her, is valid according to the Shariah or Islamic law.
The woman had left him and gone to her fathers house after a quarrel with her husband. The man then went to her fathers house and told her that he had divorced her.
Another fight then took place during which he again told his wife that he was divorcing her. Then he sent an SMS text informing her that he was divorcing her, bringing the total to three, as required by the Shariah.
Islamic scholar ruled that, though a declaration of divorce in anger in not valid, the SMS message is valid.
