Is Ted Cruz a Natural Born Citizen... of Canada?

Ted Cruz was born "Rafael Edward Cruz" December 22, 1970 in Calgary, Alberta, Canada.

His mother is US citizen Eleanor Darragh.

His father is Cuban citizen Rafael B. Cruz. (naturalized as a U.S. citizen in 2005)

Eleanor Darragh and Rafael B. Cruz were residents of Canada for at least four years from 1970, possibly earlier, until 1974. They conducted business there as Rafael B. Cruz and Associates, Ltd.

Where they "permanent residents"?

Is Ted Cruz a "natural born citizen" of Canada?

Newsflash: Plenty of American citizens have been born not on US soil. They were born to an American citizen who happened to be in another place the day of the baby’s birth. You’re just wrong about the soil ruling the day. But in America our nation has made the stupid mistake of recognizing anchor babies born here to non-citizen mothers. That is a choice that we made, to do, that doesn’t make sense to go along with our other citizenship laws. It’s in conflict with them.

I don’t take YOU seriously. My posts are meant for others to read and take in, not meant necessarily for you.

I can’t take anyone seriously who believes that Ted Cruz has no idea what country he’s a citizen of and has spent his brilliant life not knowing he’s Canadian and here you pop up to tell him about it.

If it weren’t so bizarre, and troublingly sad, it would be rolling-on-the-floor hilarious.

I do not care whether you want to call Rubio an anchor baby he is nbC. Oooooo I am so worried about those experts who will “set me straight”.

And what law schools did they attend? btw, Mark Levin believes that Rubio is nbC. You know more than Levin?

In our argumments about "natural born citizens" in 2008 we pretty much coalesced a consensus that would exclude Ted Cruze, Bobby Jindal, and Marco Rubio. Most exempted John McCain because he was running for president as a Republican. I would include him also. Truth be told, all our stars except Sarah Palin are no-gos if we would be consistent. What the consensus on FR now seems to be is that a real conservative Republican is a Natural Born Citizen, regardless of the circumstances of his birth. The wording of the clause in the Constitution is ambiguous and would imply that an Act of Congress could define what is a Natural Born Citizen.

Unfortunately there is now a fait accompli that negates the NBC clause altogether. That will become official at some point when a British and Indonesian citizen is explicitly recognized as being or having been President of the United States.

I like Cruz. I don’t see how he is Art. II eligible. And I reject the notion that political power trumps rule of law.

Great info! Cruz is not a natural born citizen of USA, both parents required to be USA citizens when Cruz was born. Regardless that Cruz was born in Canada, given that his father was a legal immigrant to Canada (corrections welcome), I wouldn’t be surprised if Cruz is not a natural born citizen in either Canada or Cuba, but a Cuban citizen.

If US law applies to a person born in Canada, wouldn’t Kenyan law apply to a person born in the US?

I should have noted that Cruz is a USA citizen now, but was probably legally a Cuban citizen when he was born, depending on his father’s status in Canada.

At this point I wonder how many of the birthers are trolls stirring the pot and I’m one of the original “birthers”.

Ive given up on the issue due to all the experts who are now declaring everyone to be ineligible.

It is an established maxim that birth is a criterion of allegiance. Birth however derives its force sometimes from place and sometimes from parentage, but in general place is the most certain criterion; it is what applies in the United States; it will therefore be unnecessary to investigate any other.

El wrongo. The constitution mention aliens, natural born citizens, and citizens. The terms were not defined and were left to congress to define through legislation.
If you are a citizen, and you didn’t have to get naturalized, you are NBC.

In zeal to catch Obama, many try to imply a 4th type of citizenship. You are a citizen, but never had to be naturalized, but you are not natural born.

So we get treated to bizzare opinions as to how the mother must be 18, or rabbit trails through Canadian law, etc.
Cruz is NBC.
Besides, that bridge has already been crossed. Now he doesn’t even have to show a birth certificate to serve.
He cannot be require to pass any test for office that obama did not.

Wrong question.

The correct questions is: Do Canadian laws in any way effect or affect US citizenship? The answer is no.

I think people should look at this way. If a female Airman who is married to a Canadian businessman gives birth while serving in the USAF in England, the child would nbC.
