EPA's back-room 'Sue and Settle' deals require reform

Imagine the outcry if the nation woke up this morning to New York Times and Washington Post headlines reporting that in order to settle a lawsuit against Charles and David Koch, officials with the Environmental Protection Agency had met behind closed doors with them to iron out a deal that effectively allowed the brothers to rewrite regulations as they pleased. Imagine, also, that the EPA and the Kochs then got a federal court to issue a decree ratifying the deal and giving it the force of law? The sun would not likely set on a peaceful America until the EPA/Koch deal was utterly repudiated and those in government responsible for it frog-marched to jail after being charged with multiple violations of the Administrative Procedures Act.

We have got to figure a way to end this nonsense. We now have the government giving tax payer dollars to environmental groups who in turn use it to block projects the government is trying to build. It's insane.

It’s a Darwinian process designed to redistribute wealth to those Leftist groups that prove, through their lawsuit activism, to be the most active and supportive of the Leftist agenda.

The IRS will seize a business bank account on any pretext and then “negotiate” a fine. It’s extortion. If the Mafia was doing this it would be a RICO violation.

The GAO used a really poor pretext to threaten to imprison one of Honeywell’s directors in the early ‘80’s. (I knew his son.) The company and the GAO agreed on a “fine” and the ludicrous accusations vanished. It was extortion, plain and simple.

1-Close the EPA.
2-Declare ALL of it’s past rulings null and void.
3-Establish a SHORT list of NATIONAL standards for water, air, and fuel.
4-Tell all remaining federal agencies they will be reviewed for self-serving, non-value added rules and regulations, and those agencies are at risk of a similar fate.

We need to get all Tea Party, AFP, 912, Republican, Libertarian folks to start a campaign. Even leftist Dems would find it hard to justify what is going on with the EPA. We need to start taking issues like this one at a time and demand change. Your solution sounds GREAT!

Why do I have a feeling that the fine hand of Cass Sunstein (The first Regulation Czar under Obama), is involved in this strategem?

It makes perfect sense from a totalitarian point of view. Do what we want under cover of litigation and cut the public interest out of the process.

I was very interested at one point in getting rid of the EPA.

It is actually much more complicated than you think, and it may not even be possible without a reboot.

Because the Fourth Branch has no Constitutional validity, there are no procedures for dismantling it. With particular regard to the EPA, it was created by Executive Order to enforce laws (Clean Air Act, Clean Water Act, Endangered Species Act, Safe Drinking Water Act, etc.) which are themselves almost certainly unconstitutional. Congress did not create the EPA, no law exists that could be repealed, thus ending its existence.

Congress is the root of the problem. Under the current correlation of forces, I do not believe we are going to make it.

Why is it I do not trust the underlying accusation in this article.

I smell a hit on the Koch brothers by both the NY Times and Wash post. They realy dislike that the Koch Brothers are taking on Bama and the left with their own money.
