A NURSE who was severely injured in a car crash and then bitten by a dingo as her boyfriend tried to find help has been awarded compensation after a four-year battle with her insurer.
Former Alice Springs nurse Michelle Robson was a passenger in a car when her boyfriend Ihab Hassan lost control and crashed on the Stuart Highway, near the Devils Marbles, on April 21, 2009.
Mr Hassan dragged his girlfriend from the wreckage and left her by a tree while he went to get help.
She was then bitten on the hand by a dingo, which she fought off with a branch. Ms Robson was in hospital for eight days.
Following the accident, the nurse - who had been working at the Alice Springs Hospital for about seven months - made an application to the Territory Insurance Office for compensation.
But in December 2011, the insurer refused to give her benefits because it claimed her car had been unregistered for more than three months.
Ms Robson's car was registered in Tasmania at the time of the accident.
The nurse appealed the decision to the NT Supreme Court, claiming the insurer had an onus to prove the car was unregistered because it had been driven and owned by Territory residents for more than three months.
But Justice Judith Kelly said the crash happened after the couple had left Alice Springs, heading back to Tasmania, so they were no longer Territory residents - meaning the insurer could not rely on an exclusion to benefits under the Act.
"Neither one had a job in the Territory; neither one had a home in the Territory," she said.
She said Ms Robson had a home in Launceston and had a job lined up at the hospital.
Justice Kelly said the insurer was in error finding the car was unregistered.
Thankfully, there was no baby involved.

As a very old AF radar controller I know a number of DEW line jokes. After a while we numbered the jokes so we didn’t have to tell them. Just say 12 and everyone would laugh. New guy comes in and old guy Jack says, 18 but no one laughs. New guy askes why? Someone says, Jack never could tell a joke. You would fit right in.
