Woman Says Computer Tech Uploaded Her Nude Pictures to Web, Files Lawsuit

University of Alabama student Nicole March claims that a member of Best Buy's Geek Squad posted her nude photos on the web after fixing her computer.
March has filed a lawsuit against Best Buy, claiming that she is "devastated and humiliated" by the incident.
Her lawyers claim the pictures were taken for an art project at school, where she was studying the human form.
According to March's lawsuit, she took her computer to a Best Buy store in Tuscaloosa, Alabama to fix the hard drive in August 2011. March also works at the same Best Buy.
However, in May of this year, she was told by a different Geek Squad worker that nude pictures of her were on the Internet, notes AL.com.
March's lawsuit claims an unidentified Geek Squad employee took the photos from her computer, uploaded them to the web and linked to the pictures via Pirate Bay, a popular bit torrent file-sharing site.
She complained to the police, but the statute of limitations had expired. She complained to Best Buy, whose manager identified the Geek Squad member, but would not tell March who it was.
Best Buy told March they would try to get the pictures off the web, but there is no guarantee they can.
March's lawsuit claims Best Buy invaded her privacy and was negligent in the supervision and training of its employees.
A Best Buy spokesperson said the company is waiting to see a copy of the lawsuit.

More than one tech site has caught Best Buy/Geek Squad in the act of sifting through personal data and copying that which they should not access, often via the USB key that contains anti-malware utilities. No shock that beach/bikini photos were popular with them.
The tech sites simply ran a video capture program in the background and caught them red-handed.
The Geek Squad concept is cute for about 2 seconds until you realize the creeps they’ve hired would still be creeps without the white ties and black shirts. Giving them access to one’s data is a mistake.

No argument there. And I would even argue that Best Buy was wrong and she should win her lawsuit. If I were on the jury - Id award her the sum of One Dollar.
Interesting. Now imagine that you also kept copies of your SS card, tax returns and birth certs on your computer and they lifted and posted that on the internet?
Did they or did they not steel personal property. The courts recognize personal property in copyright laws.
I would award about $100K... for damages and punitive.

You equate some bimbo posting nude pics of herself with SS records, tax records and birth certs? It's a property issue. Was the property stolen or wasn't it? If so, a crime was committed. The crime can be litigated in civil court since the statute of limitations has expired legally. The sticky part is... what damages is the criminal liable for?
I expect, being the intelligent, wise and respectful FReeper that you are, you cannot relate to storing nude photos of yourself on your computer. But I would expect there are some things on that machine you would not want to be distributed for any multitude of logical reasons. I simply used an analogy that someone as sophisticated as you might better relate too.
Does that help explain the analogy I used to point out the significance of "property" being stolen?

She should have smashed the hard drive with a sledge hammer instead of handing it over to the Geeks.

She did not post the pics of herself on the internet. The Geek Squad tech took files that were hers from her computer and posted them on the Internet without her permission. It doesn’t matter what the contents of the files were. The tech could have just as easily stolen tax records with her SSN and sold them to identity thieves. They could have taken private emails and posted them online for their entertainment. The point is, it’s wrong no matter what was taken.

Hah! You must not know me very well. Ask anyone - even my friends.
I get your point. But “property” as you call it has a value. To place a 100,000 dollar value on nude pics being stolen is ludicrous.
