Woman Says Computer Tech Uploaded Her Nude Pictures to Web, Files Lawsuit

University of Alabama student Nicole March claims that a member of Best Buy's Geek Squad posted her nude photos on the web after fixing her computer.
March has filed a lawsuit against Best Buy, claiming that she is "devastated and humiliated" by the incident.
Her lawyers claim the pictures were taken for an art project at school, where she was studying the human form.
According to March's lawsuit, she took her computer to a Best Buy store in Tuscaloosa, Alabama to fix the hard drive in August 2011. March also works at the same Best Buy.
However, in May of this year, she was told by a different Geek Squad worker that nude pictures of her were on the Internet, notes AL.com.
March's lawsuit claims an unidentified Geek Squad employee took the photos from her computer, uploaded them to the web and linked to the pictures via Pirate Bay, a popular bit torrent file-sharing site.
She complained to the police, but the statute of limitations had expired. She complained to Best Buy, whose manager identified the Geek Squad member, but would not tell March who it was.
Best Buy told March they would try to get the pictures off the web, but there is no guarantee they can.
March's lawsuit claims Best Buy invaded her privacy and was negligent in the supervision and training of its employees.
A Best Buy spokesperson said the company is waiting to see a copy of the lawsuit.

The young woman in question posted exactly nothing of herself anywhere. They were on HER computer. It was the geek squad creep who did the posting.

I get your point. But property as you call it has a value. To place a 100,000 dollar value on nude pics being stolen is ludicrous. Punitive damages are relative to the entity that is found guilty (liable) for the damage. It's punishment payment. I don't normally agree with punitive damage awards (like HOT McDonalds coffee). But the OJ Simpson Civil Trial seemed to fit the reason punitive awards exist. Precisely when no tangible value can be attributed to a loss, in this case personal private data. In the Simpson Civil Trial the damages were for what, that value of Nicole's life?
Personal photos are property per copyright law.

This is an accusation. Not one shred of evidence has been offered in the article.
According to the article, Ms. March allowed photos to be taken of her nude. No explanation is given about how those photos were protected or how their distribution has been traced to the Geek Squad member.
So all we have is “she said”.
Until credible evidence is presented, I will stay off the condemnation bandwagon.

I would keep confidential data(or your nudie photos for that matter) either in encrypted files or better still stored on secure external media least your computer is hacked, lost, stolen or needs repairs. If she was attached to the college network without adequate firewall protection her photos may have been compromised too.

That’s my ultimate defense, too. If there were such pictures, who would care? Anyway, once you’ve given birth ten times, it’s like practically the whole state - well, three states - has seen you naked.

The legalities as I understand them:
On your computer, they are your property, and a crime has been committed if someone takes and uploads them (hacking of Scarlett Johansson’s cell phone).
It is debatably a crime, depending on the jurisdiction, to hide a camera in a peephole and film someone getting naked (Erin Andrews...but in some other jurisdictions there was no specific law against this and prosecutors had trouble coming up with something to charge)
If you take naked pictures of yourself and give them to your honey, and later you break-up and you become rich and famous, he is free to sell them to a tabloid because you gave them as a gift and they are his property (Kristin Davis, Dr. Laura)

Do you still hold on to that claim? YES. I may have to retract my previous assumption about your intellect and wisdom as you seem to be incapable of grasping the meaning of punitive damages associated with civil lawsuits. I don't know how else to explain my opinion. Here is the definition of Punitive Damages....
Punitive Damages: Damages awarded in excess of compensation to the plaintiff to punish a defendant for a serious wrong.
