Couple Wins $50M in Biggest “Wrongful Birth” Suit, Doc Didn’t Suggest Aborting Disabled Baby

A couple in Washington state have won what is being called the biggest so-called “wrongful birth” lawsuit ever, when their doctor didn’t suggest aborting their disabled unborn child.

A jury in Washington state awarded a couple $50 million after genetic tests didn’t give the couple the information they wanted to know about whether their baby had a rare genetic disorder. Had the baby had the disorder, the couple planned to take his or her life in an abortion.

“Brock and Rhea Wuth of Burien, Wash., sued Valley Medical Center and the North Carolina company LabCorp after a genetic test meant to determine whether a child Wuth was carrying had a rare genetic disorder failed to do so,” UPI reports. “The Seattle Times said the couple knew based on their family medical history they were at a 50-50 chance of having children suffering from a rare but debilitating genetic disorder called “unbalanced chromosome translocation.”

This case comes on the heels of one from New Zealand, where a couple won their case at a federal appeals court because they would have aborted their little girl had they known she had spina bifida. The parents of a child with the condition could win a monetary settlement following the ruling saying they were “denied” a chance to abort their daughter.

During ultrasounds scans as the pregnancy progressed, doctors missed signs of the birth “defect” and the couple said that, had the spina bifida been detected, they would have killed their daughter in an abortion. Instead, the little girl was born in 2007 and the couple has been in court even since. The Court of Appeal ruling claims the couple “suffered a personal injury because of the misdiagnosis” and the case now returns to a district court.

More on this new case out of Washington state:

Knowing they were at risk, Rhea Wuth went to Valley to have her fetus tested. The hospital then sent the blood sample to LabCorp. The problem happened when the hospital failed to include crucial data about where the lab was supposed to look for a chromosomal defect — essentially a genetic roadmap for where the defect would occur if at all.

Lab employees never followed up to ask for the crucial information, missed the translocation and came back with a negative result for the disorder.

When the couple’s child was born July 12, 2008, he was found to suffer from the disorder. The child, Oliver, now requires around-the-clock care. He has an IQ of between 50 and 70, cannot run or walk up stairs and can’t speak beyond two dozen or so words his parents can understand.

The Wuths’ lawyer, Todd Gardner, said the couple was “incredibly responsible” in seeking out the testing and had they been given the proper test results they would have terminated the pregnancy.

My adult nephew can’t speak any words, yet he is loved by his parents, siblings, and his extended family. He also requires around-the-clock care.

God help us.

You know what? I can understand that this child did not live up to their expectations. Really I can understand. Every other kid is out playing on tricycles and their kid is what? Lying in bed still in diapers and most likely will be, forever.

However I would like to say this to Mr. and Mrs Wuths and I hope they are reading this now. Mr. and Mrs Wuths there are “Safe Haven Laws” in your state and yes they would have applied to you. You could have left little Oliver in the hospital the day he was born no questions asked. You could have told family and friends he was a still birth if you were afraid of stigma or what ever. There are people who would have loved to adopted Oliver. I understand you don’t want a baby like Oliver but believe me there are people in this world who do. Why on earth did you put yourself through the mental stress of a lawsuit when you could have left him at the hospital and this would have been over and done with?

By now you could have been pregnant again with possibly what you call a “normal” baby.

Was all this crap really worth it?

The hospital I worked at for more than 20 years had an agreement with a nearby state psychiatric hospital to provide care for their residents.As a result we saw many of them in our ER when they were physically ill.Many of term were Downs Syndrome victims.I was always struck by how gentle...how “sweet”...they were,even when they weren’t feeling well.

Let them enjoy their ill gotten gains here on earth—it may be at the expense of a glorious eternity with our Lord in Heaven, where their child will, without a doubt, be, but, HEY-—they’re gonna be “rich”!

How much do you think it costs for around the clock care for this child?

Who is paying right now? Seems to me that the costs of caring for the child should be borne by the ones who mad the bad diagnosis.

They want children, but the extreme demands of caring for this one have forced them to use birth contra to prevent others.

Why is the one, defective, child so much more important than the siblings who never saw life at all because of the first-born?

That couldn’t be any further from the TRUTH.

He is called, “the ruler of this world” in John 12:31, and God’s ENEMY.

In 1 John 5:19, God’s Word says that, “the whole world is lying in the [power of the] wicked one”.

30 Hereafter I will not talk much with you: for the prince of this world cometh, and hath nothing in me. 14:30.

11 Of judgment, because the prince of this world is judged.16:11.

4 He is called: “the god of this system of things”, in 2 Corinthians 4:4....4 In whom the god of this world hath blinded the minds of them which believe not, lest the light of the glorious gospel of Christ, who is the image of God, should shine unto them.

Satan rules the world and its politics. Soon, it will be taken away, and Jesus will “destroy them which destroy the earth” and create real peace after man’s short false peace. 1 Thess. 5:2-3.

The list, is long, however, these facts (and others)have certainly been emphasized in God’s Word, by its repetition!

The Book of Job, addresses the problem of “human suffering”. In the sense of what you perceive as “Satan working FOR God, is about God ALLOWING Satan to visit terrible trials on Job so as to TEST his trust and faith in God. And, it also shows us His Sovereignty in that we CAN persevere...no matter the circumstance, if we just TRUST HIM. Satan still must OBEY God, even though he rebelled against the TRUTH, which is God.

What kind of people are those ‘friends’ of theirs anyway? I can honestly tell you I know someone who did abort a baby because it was retarded. You know what? That is not the kind of person I want to be friends with! So these are not the kind of people I’d want to be friends with. They are not impressing anyone worth impressing!

Yes I know this and if only OB’s would tell patients about the “Safe Haven Law” as a back up plan? It is an option! It’s better than abortion.

I’m not sure why you won’t give God the respect of the fullness of His Name when you are referencing His Name, in type. It is spelled GOD. GOD, is not a “fill-in-the-blank name, but the Name of GOD.

Also, I am not disputing, OR have I changed God’s Perfect, and Eternal law.

So, to what do you refer?....because Satan, whether you choose to acknowledge it or not, IS the god of this world until Christ returns. The reason Satan is the current ruler of this world, goes back to the Garden of Eden. When Adam and Eve disobeyed God and ate of the Tree of Good and Evil, they allowed Satan to rule them instead of God. If Adam and Eve had resisted Satan and obeyed God, then Adam and Eve would have been under the Government of God. By yielding to the lies of the serpent, they started the process of the whole world being under Satan’s sway. Christ even realizes that Satan is current ruler of this world.

1 John 5:19 … the whole world is under the control of the evil one.

His power is so extensive that he is over all the nations of the earth. Jesus calls him the ruler of this world (John 14:30).

John 14:30
30 Hereafter I will not talk much with you: for the prince of this world cometh, and hath nothing in me.

And you SHOULD stick to what God’s Word says, as it is also in the Hebrew bible, these things. Nothing has changed.

You are correct. God’s Word changes not. Nor will He be mocked. God is still sovereign....but also, it does mean that God, in His infinite wisdom, has allowed Satan to operate in this world within the boundaries God has set for him. When the Bible says Satan has power over the world, we must remember that God has given him domain over unbelievers only.

2 Corinthians 4:4

Evil in the Last Days

And just to clear things up a bit....Christianity is a “way of life”. A personal relationship with our Lord, Jesus...serving Him, and doing His Will. One of which, ALL should aspire to do. To return to God’s intended plan for us(mankind), which is worshiping Him. And doing so, willingly, and faithfully.

However, you are incorrect with your insinuation about the ‘Christian bible’. There is no such thing as a “Christian bible”. It is the “Holy” Bible. The Divinely INSPIRED Word of God. And Jesus Christ IS His ONLY begotten Son, given to us as our Savior, and Mediator between God and man. Jesus is the expressed image of God’s being. For there IS no other. The Holy Bible is for ALL people.
