You are exactly right. I am impressed by stances both have taken in several cases. Considering who nominated both of them, it seems better to praise their good calls more and damn their expected calls less. When someone is heading in your general direction when you don’t expect it, don’t discourage it.
Maybe Kagan and the wise Latino are evolving? These justices never have to face the voters - they are appointed for life terms, so, if they are appointed they can possibly disguise their true feelings until after they get seated. I’m reminded of Sandra Day O’Connor, appointed by Ronald Reagan and what a disappointment she turned out to be. So, maybe there is some hope for these 2 after all. And, I believe there is a special place reserved in hell for Ruth Gingsberg.
