No the 14th ammendment has been misinterpreted to allow illegals to come to the US give birth and have a US citizen to “anchor” them here permanently. That is not what the 14th ammendment was created for. The USA is the only nation on Earth who allows this nonsense. It needs to stop.
How do you think all these illegals get EBT cards? They have at least one kid born here who is a US citizen so they run down to family services and get signed up.
Not so. Canada and Mexico have birthright citizenship along with about 30 other countries, most of them in North, Central, and South America.
While the courts have used the 14th in that manner, title 8 section 1401 is the section of law where Congress has expressed it’s will concerning the enumerated power of Congress as detailed in Article 1 section 8 of the Constitution.
Title 8 section 1401 subsection a reads:
The following shall be nationals and citizens of the United States at birth:
(a) a person born in the United States, and subject to the jurisdiction thereof;
So it is the expressed will of Congress that they be citizens. If that is to change, we will need to change Congress.
It’s true that the writers of the 14th should have been more specific in that it referred to freed slaves and their descendants. I’m not sure why they weren’t, but, unfortunately it says what it says. I have pissed off liberals, who object to the language of the 2nd Amendment, and drug warriors. The Constitution and its amendments says what it says, and a court has apparently affirmed that the 14th means that babies born in the US, even if their mothers are here illegally, are citizens.
As we will not get a court to change that interpretation anytime soon, we’re left with the option of changing the wording via another amendment. It’s not a pleasant conclusion but it is the harsh reality that we face, especially if we make the claim that we believe in the Constitution, and the rule of law.
