Lawyers: Gay marriage a detriment to children

Lawyers who are appealing a federal judge’s ruling that overturned Oklahoma’s ban on same-sex marriage said in a court filing Monday that legalizing gay marriage would harm children, undermine society and make traditional marriages unstable.

The Alliance Defending Freedom cited courts and anthropologists, saying children are better off in a home with a mother and a father. It said traditional couples would be less likely to marry, or stay together, if marriage became a genderless institution not focused on procreation.

U.S. District Judge Terence Kern ruled last month against Tulsa County Court Clerk Sally Howe Smith, whose office refused to grant a marriage license to two women who wanted to marry. Monday’s appeal is the first step in the process ahead of an April 17 hearing before the 10th Circuit Court of Appeals in Denver.

I think they should stick with the argument that being raised by two people of the same sex, rather than one of each, is harmful to children. I think they could prove that with studies etc. (kids dropping out of school, rates of depression, etc.) and make it stick. Then they could make the argument that the state attempts to prevent or mitigate harm to its least powerful citizens, children. But arguing that gay marriage destabilizes straight marriage is a hard thing to prove objectively.

Maybe a legal expert here can answer this question, but when did this country decide that a law could not be passed unless there was a very good reason for it, independent of morality?

That seems to be the nature of the defense we are forced into.

Sharon Baldwin and Mary Bishop, who had applied for the marriage license, issued a statement Monday night saying Alliance's brief relies "on outdated and debunked science as far as saying that children need both a mother and a father."

Okay, go out and have your own child. Don't steal one from a hetero couple.

Seems the conservatives are throwing the game by design. This is very poor, non-legal argument that cedes the point that homosexuality is an inane characteristic, like race. They need to be arguing that sodomy is a behavior, not an inane characteristic and everyone, no matter how they self identify, has the equal right to marry under the law that marriage is between husband and wife.

Even as a staunch conservative, I would have to rule against the law if this is the argument. There is no legal basis for it.
