Man adopted in Ky. by member of same-sex couple

LEXINGTON, Ky. (AP) — A Kentucky judge has finalized the adoption of a 28-year-old man by a woman who was legally married to his mother in Massachusetts, the first step-parent adoption by a member of a same-sex couple in Fayette County and possibly the state following a federal court ruling.

Can I ask a stupid question? How do you adopt a 28 year old? He’s legally an adult. How is this legal or permissibile in the first place, aside from the homosexual angle???

His mom is a lesbian and a married one at that.

Odds are that the adoptee is gay or has some other malfunction.

There's probably an estate planning and inheritance issue at stake here.

There was a bizarre case of two elderly "gay" men in Pennsylvania who were trying to work out some kind of deal like this. One of them was in his 80s and his "partner" was in his late 60s. They wanted to be considered spouses for some kind of tax/inheritance purposes. Pennsylvania law didn't allow them to be married, so they tried to get around the law by having the 80+ year-old guy adopt the guy in his 60s.

A Pennsylvania court ruled that the older one couldn't legally adopt the younger one because the father of the younger one was still alive. So -- get this -- they got around that little problem by having the guy in his 60s adopt his older "partner."

If you're going to live in a freak-show, it might as well be an entertaining one.

My friend adopted his step daughter when she was an adult.
The sperm donor was a terrible drunk and the girl felt it was very important that the guy who actually helped her mother raise her become her legal parent. It was largely symbolic but the girl felt very strongly about it.

I’d imagine it’s legal because it assures inheritance of property and (in English law) titles. But it’s being used to expand “rights” that do not exist. (Only, now they do.) The LGB lobby is very clever.

There must be other creative ways around taxes/inheritance tax without using “adoption.”

For example: Why couldn’t one guy simply write the other guy into his will? Or why couldn’t they just add each other’s names to each other’s accounts and investments?

A person can leave an inheritance to a spouse without paying estate taxes on any of it, and there may be life insurance provisions based on a second-survivor policy (it's complicated, but basically both partners are insured under one policy). It may be necessary to have both "partners" listed as spouses, and to have the adult "child" listed as the legally adopted child of the second partner, to deal with potential legal challenges from other children from a prior relationship.

I don't pretend to know all the details of this, but it is not unusual for people to come across situations like this in financial/estate planning.

A large part of the gay marriage push involves legal status regarding inheritance, That is probably the reason for the case cited.
