Family Dog Found Dead Inside Car Stolen from Gilroy Walmart

South Bay man has SUV stolen with dog inside. Dog found dead.

A South Bay man suffered a double-tragedy after his SUV was stolen with his dog inside. The car was recovered with the dog inside -- dead. George Kiriyama reports.

Car thieves apparently abandoned a stolen SUV with a dog inside, leaving the animal "to die."

Michael McVey had his Nissan Pathfinder stolen from the parking lot at the Walmart in Gilroy. Inside the vehicle was his beloved dog, Keiko.

"I could care less about the car," McVey said. "The dog, we've been friends for a long time."

For 15 years, McVey and his dog did everything and went everywhere together.

Baltimore Cop Beat Girlfriend's Dog to Death: Police McVey and his friends spent days searching for Keiko, hoping whoever stole the SUV let the dog out.

The vehicle was recovered four days after it was stolen. Police found the SUV in San Jose with the dog inside, dead in the backseat.

McVey said he wept for days, wondering how someone could do this to his dog.

"It would have been best if they just let the dog go somewhere," he said. "It would have been best if they just let the dog go in the parking lot and kicked her out of the car cause she would have come and found me."

Too Much Caffeine? There's An App For That Police are now searching for two persons of interest caught on surveillance footage by a Walmart camera.

"I'd like to know what kind of people they are," McVey said. "That they could torture an animal like that."

I’d never leave my dog in my vehicle. And why should anybody expect a scumbag car thief to “do the right thing” and let the dog out?

Same thing happened here in Los Angeles many months back, car was stolen with a dog in the back seat, car was found with the dog dead a few days later, windows rolled up, so sad

There are 14 states – Arizona, California, Illinois, Maine, Maryland, Minnesota, Nevada, New Hampshire, New Jersey, New York, North Dakota, South Dakota, Vermont and West Virginia, that currently have statutes “that specifically prohibit leaving an animal in confined vehicle“.
California: Cal. Penal Code § 597.7 : Leave or confine an animal in any unattended motor vehicle under conditions that endanger the health or well-being of an animal due to heat, cold, lack of adequate ventilation, or lack of food or water, or other circumstances that could reasonably be expected to cause suffering, disability, or death to the animal.

First conviction: fine not exceeding $100 per animal.

If the animal suffers great bodily injury, a fine not exceeding $500, imprisonment in a county jail not exceeding 6 months, or by both.

So in this case, with the Dog having died because it was left in the car unattended, the owner, having lost his dog, could actually be put in jail for 6 months.

You can't read a criminal statute that expansively. It's read the other way around, in favor of the accused.

The statute enumerates certain conditions that "endanger the health or well-being": temperature, lack of air, food, or water 'or other circumstances that could reasonably be expected to cause' harm.

Just leaving your dog in the car, without knowledge of any dangerous circumstances, other than that somebody MIGHT steal your car and then abandon the dog, is not contemplated by the statute. Third-party criminal conduct is generally an intervening cause.

The answer would be no in this case. The DA would have to provide evidence the owner intentionally left the dog unattended when it either too hot, cold, not ventilated, or left without food or water. Nothing could be proved in this case.

However the car thief could be convicted in this situation. There is a case in the LA area where the car thief is being charged with animal abuse.

My little dog would bite the crap out of them. Especially if they’re dark skinned. She just doesn’t like blacks and Hispanics. I have no idea why. A white person can walk by the car and she just looks. A black or Hispanic walks by and she goes nuts.

Some dingbat left her dog in the car this summer and my wife called the cops. Before she got off the phone the woman showed up. My wife called her a stupid bitch.

My little dog hates people on skateboards, barks the hell outta them, dont know why, he just doesn’t like them..Once he barked so loud when a skateboarder passed by he got scared and fell off of it..our other dog Maxie(Shih Tzu) doesn’t care for black people either, dont know why, especially black men, a black woman walks by and nothing but a black guy comes and he goes nuts too
