Christian college slapped with Title IX claim for denying transgender female room
Daily Caller ^ | 04/08/2014 | Eric Owens

The George Fox campus only has single-sex dorms. Officials at the Christian school previously turned down Jayce’s request to live in an all-male dormitory. Last week, they chose not to hear an appeal.

The complaint, filed by attorney and transgender activist Paul Southwick, leaves Jayce’s current genitalia situation very ambiguous but takes pains to indicate that “Jayce presents as a male and only goes by male pronouns such as he, his, him etc.”

‘“Jayce presents as a male and only goes by male pronouns such as he, his, him etc.”’

How about going by she, shis, and shim?

There are two* sexes. If you want to know a person’s sex, you can do it the same way you do it with dogs. Look between their legs.

*hermaphrodites notwithstanding.

“Jayce presents as a male and only goes by male pronouns such as he, his, him etc.”

If she "presented" as a kiwi and only went by neutral pronouns, that would not entitle her to a place in the salad bowl. Why should pretending to be male earn her a place in a male dormitory?

Only if a hermaphrodite. Otherwise, the only think ambiguous is the person’s sanity.

A smart guy would say he associates as a woman and demand a spot in the girl’s dorm.

Oh for cripes sake.

Jayce, drop your pants and we'll tell you which dorm you get a room in.

OTOH, if Jayce is this screwed up, do they really want her in their school?

We are getting to the point we need a squad, actually a division more likely, of vigilantes to take out those who perpetuate this type of societal upheaval. Their motto would be “you have a problem, you get rid of the problem, and then you don't have a problem”.

This isn't properly a Title IX issue.

"No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving federal financial assistance."

The 'educational benefits' do not extend to the dorm room. If it did, you could then rightly argue that same-sex dorms themselves are illegal, since they clearly segregate on the basis of gender.

Correct.

Particularly at a private school which it is specifically targeting to ensure the "rights" of the deviants trump the rights of everyone else.

I think it’s way past time to push back against crazy people doing crazy things.

Our Constitution does NOT require normal people to participate in the fantasies of the mentally ill.

If some crazies are so out of touch with reality that they will not accept the “junk” they were born with, then they need to be separated from normal society before they hurt someone.

Not fair. That was written back when there were only two sexes, and, as I recall, they were recognizably different.

My daughter received a 25k guaranteed 4 year scholarship to this college. We turned it down because we feared too many people would be attending the school that don’t really follow Christ. I have no regrets.

SHE ISNT A GUY!

Just because you grow facial hair, talk with a deep voice, and “act” like a guy does not make you a guy!

Science (you know, the thing the left pretends to believe in) will always show that your chromosomes are that of a female 1000000000000000000000000000000000000% of the time.

So you are a girl. Deal with it.

True but I wonder what’s to stop this from happening at any private Christian college really (or any college)? Liberty or wherever. I would think nothing is there to stop it.

To: Rusty0604; All
If Christians don't know the Constitution, of course they're going to get slapped with unconstitutional state laws that attack their 1st Amendment religious protections.

State officials in New Mexico, Oregon and activist justices on the Supreme Court are wrongly ignoring Section 1 of the 14th Amendment. Section 1 prohibits the states from making laws which unreasonably abridge constitutionally enumerated freedoms. And since religious expression is an enumerated freedom and so-called gay rights are not enumerated, there is no question that the states in question and activist justices are deliberately wrong on this issue imo.

They're getting away with this crime, again, because parents are not making sure that their children are being taught the Constitution as the Founding States, and later constitutional lawmakers, had intended for the Constitution to be understood.

More specifically, regardless of today's pro-gay PC interpretations of the Equal Protections Clause of Section 1 of the 14th Amendment, please note the following. The Supreme Court had decided in Minor v. Happersett against Virginia Minor's argument that her citizenship automatically gave her the right to vote because the Equal Protections Clause meant that the fact that she was a woman was irrelevant. The Court argued that the 14th Amendment added no new rights to the Constitution, but only strenthened existing rights.

“3. The right of suffrage was not necessarily one of the privileges or immunities of citizenship before the adoption of the Fourteenth Amendment, and that amendment does not add to these privileges and immunities. It simply furnishes additional guaranty for the protection of such as the citizen already had (emphasis added).” —Minor v. Happersett, 1874.

So since women had no constitutionally enumerated right to vote before the 14th Amendment was ratified, they had no right to vote after it was ratified regardless of their sex and the Equal Protection Clause.

The same argument applies to gay "rights." Since such rights were not enumerated before 14A was ratified, the Equal Protections Clause did not automatically establish such rights after 14A was ratified.

In other words, the states are free to make laws which discriminate on the basis of anything not expressly protected by the Constitution, as long as such laws don't also abridge constitutionally enumerated rights. What the Equal Protections Clause does, imo, was to prohibit the states from singling out Irish Catholic men, for example, preventing them from voting.

Note that the states ultimately resolved Virginia Minor's argument concerning the Equal Protections Clause by ratifying the 19th Amendment to the Constitution which effectively gave women the right to vote.

Again, Christians have to get themselves up to speed on the Constitution and its history in order to protect themselves from worldly government "leaders," actually a much smaller challenge than studying the Holy Bible imo.

After monopolizing staff for ‘hours’ of discussions, she was offered a separate room by herself and a personal liason to make her feel ‘comfortable’ on campus. She declined and would rather an entire boys’ dorm be made uncomfortable instead. I think the college has done quite enough to accommodate this child’s egocentric narcissism and it’s time for the psychiatric community to take over.

It is tied to government funding, if a university takes funding from the government via the student, you will be subject to the government.
