Sotomayor accuses colleagues of trying to ‘wish away’ racial inequality
Washington Post ^ | April 22 2014 | Robert Barnes

Justice Sonia Sotomayor’s fierce defense of the affirmative action efforts like the ones that helped move her from a Bronx housing project to the upper echelons of American law found renewed voice Tuesday in an impassioned dissent that accused colleagues of trying to “wish away” racial inequality — and drew a tart response from Chief Justice John G. Roberts

What should we expect from someone like Sotomayor. She is basically saying “please give people like me special, unconstitutional favors because I’m incompetent.” She should be dismissed from the court. But so should all the other libs on the court.

The unqualified ditz sitting on the SCOTUS only because Barry and the ‘RATS thought that she had a cute “compelling life story”. Everyone knows a “compelling life story” trumps being a brain dead moron every time. She’s an gringo-hating moron.

Her faux outrage at the decision speaks more about her inability to think and reason. Which are essentially nil.

It is becoming clear that the terms "racism" and "racial inequality" and "affirmative action" are code words for the "War against America"...and particularly the "War against Whitey's America."

Where do these people think America came from? Do they think it just rose up out of nothing to become the greatest nation in the world? Did they ever stop to consider that it was the white man's adoption of Judeo/Christianity that made us great?

America is not a white nation or a black or brown nation...we are Christian nation.

And when we lose that (to achieve which Obama is so diligently striving)...we will sink back into the mire of history.

Of course, that won't happen.

As Jesus said, "be of good cheer."

Christianity is so incredibly powerful that it has overcome Maoist China...it can certainly repel a pretty widdle queen like Obama.

“The unqualified ditz sitting on the SCOTUS only because Barry and the ‘RATS thought that she had a cute “compelling life story”. “

The following Republican Senators voted to confirm Ms. Sotomayor:

Susan Collins, Olympia Snowe, Judd Gregg, George Voinovich, Mel Martinez, Richard Lugar, Christopher Bond, Lindsey Graham, Lamar Alexander.

To his credit, John McCain voted against confirmation. McCain statement regarding his vote — “However, an excellent resume and an inspiring life story are not enough to qualify one for a lifetime of service on the Supreme Court. ... Her writings demonstrated that she does not subscribe to the philosophy that federal judges should respect the limited nature of the judicial power under our Constitution. ... And, as I stated earlier, regardless of one’s success in academics and in government service, an individual who does not appreciate the common sense limitations on judicial power in our democratic system of government ultimately lacks a key qualification for a lifetime appointment to the bench.”

OK, so what is the possible legal basis for giving someone like Sotomayor special rights????

To a certain extent I can understand blacks (slavery) or Native Americans (violation of treties, seizure of lands). But for he other folks who made the decision to come to America, they should all be treated the same way.

Affirmative Action is un-American and inherently unconstitutional because it denies equal protection under the law to citizens not of a “protected” class.

“To disagree with the dissent’s views on the costs and benefits of racial preferences is not to ‘wish away, rather than confront’ racial inequality,” Roberts wrote.

“People can disagree in good faith on this issue, but it similarly does more harm than good to question the openness and candor of those on either side of the debate.”

TART????

Hardly, but then that is Roberts so what do you expect. Soto-Mayor needs to be impeached. Her perspective of the Constitution, Bill of Rights and Civil Rights is as distorted and sick as Obama’s and Holder’s.

Actually, there was a very great deal of truth in the stereotypes of Irish immigrants held by many Americans. They were the underclass of their day, and suffered from most of the pathologies of today’s underclass.

That they worked their way out of this mess is a tribute to them. Especially to their women and clergy. But making assumptions about what the Irish of 1850 were really like based on the Irish of today is just silly.

I highly recommend this article: How Dagger John Saved New York’s Irish http://www.city-journal.org/html/7_2_a2.html

The saddest thing about today’s underclass is that they have no leaders who encourage them to do the same. White liberals and their own “civil rights leaders” just encourage them to blame others and wallow in their despair.

The way that activist justices like Justice Sotomayor talk, you would never know that the law of the land is an amendable Constitution.

But I think that the real problem is that Sotomayor doesn't want low-information citizens to find out that it is the states, not the Supreme Court or any other branches of the federal government, who uniquely have the constitutional Article V power to ratify new amendments to the Constitution which would enumerate racial protections.

In fact, the states ratified the 15th Amendment to expressly protect voting rights on the basis of race.

So what Justice Sotomayor needs to do if she really wants to limit racial discriminaton on additional issues within the framework of the Constitution, as opposed to twisting the arms of her colleagues to wrongly legislate such rights from the bench, is the following.

Justice Sotomayor needs to work with both state and federal lawmakers to proprose additional anti-racial discirimation amendments to the Constitution to the states for ratification. And if the states chose to ratify her amendments then the states will have less power to discriminate on the basis of race and Sotomayor will be a hero.

Question: Went in history is it just to punish an innocent person for some other persons crime simply because the criminal and the innocent person we're the same race.?

By that logic should the order in line be by percentage of your racial makeup and if your related in any way to the impacted party?

Obama is 50% white of an old America family and 50% non white first generation. .so by blood he 50 % guilty oppressor and 50% of a non victim...so how does he go in front of a first generation anyone of any race makeup?

I would think most minorities elevated to positions beyond their competence must know that most non-minorities have no respect for them. As they would for anybody, white or black, given something they were not competent to perform. Like the CEO of a major corporation handing the reins to his oldest kid. Anybody working in that corporation would have a deep distrust of the son of the CEO.

I saw a video clip of Sotomayor talking with one of the muppets on Sesame Street, and her explanation was that she solved problems by giving her opinion. It seems to me that Senora Sotomayor believes in making decisions based on her liberal gut, not what the Constitution actually has to say.

We’d be remiss in not pointing out there were laws explicitly designed at Black exclusion in this country. The problem is that you cannot make up for what was done in the past by then turning around and discriminating against the majority color (White), which also discriminates against Asians (who themselves were also targeted with racial laws in the past). What the left won’t accept is that, at this point, we’ll never move past racism if they keep infusing race in every issue. Doing away with racial preferences entirely and judging the individual solely on merit (not on things they have no control over, such as race or gender) is the only equitable way to go.
