The question is whether he crossed the line from self-defense to execution. According to the DA he was waiting, they were unarmed, did not surprise him, made no attempt to harm him, and then he drug the bodies across the floor, putting finishing shots into their heads, I really don’t know if a jury is going to believe self-defense if those are the facts.

It is time for Jury nullification. On occasion something illegal is justified.

“A few minutes later, Smith heard footsteps above him. As in Brady’s case, Kifer too started down the stairs and was shot by Smith by the time he saw her hips, sending her tumbling down the stairs.

Smith attempted to shoot her again, but his rifle jammed, prompting Kifer to laugh.

Upset, Smith, pulled out a revolver he had on him and shot her “more times than I needed to” in the chest, he said.

Smith dragged Kifer next to Brady as she gasped for her life. He pressed the revolver’s barrel under her chin and pulled the trigger in what he described as a “good, clean finishing shot” that was meant to end her suffering.”

This is one of the reasons that Mr. Smith is going to court.

Don’t forget the part about this guy dragging the bodies around inside of his home and then not telling anyone he had two bodies in his house until a day later.

And yet some people here have stated they have no problem with this guys actions.

He did save the Fire Dept. a lot of money. Just think of the resouces they would have had to use try to resucitate these two and probably would have died anyway.

BTW for you “it was premeditated” folks he’s only charged with Murder 2.

I live alone. I have a gun within reach. Does that mean I’m waiting for someone to break into my house so I can shoot them? ....Answer is: I’m prepared to shoot someone if they break into my house, and I will do so.

You and cherry seem to think the guy lured the two teen thugs to his house so he could kill them. Ludicrous.

there are specific rules regarding the use of deadly force in MN. All four of these must be met before you use deadly force:

1. Reasonably in fear of death or great bodily harm for yourself or another.
2. Must have reluctantly entered the conflict.
3. Must have no reasonable means of retreat.
4. No lesser force will suffice to stop the threat.

That seems to fit and he'll will likely do hard time and probably should.

Did ya hear he parked his vehicle down the street from his house prior to this? Perfectly legal, but why do you think he did that?

When I heard this guy was dragging the bodies around inside of his home and then not telling anyone he had two bodies in his house until a day later, it kinda bumped my WTF meter.

Then he recorded the entire event?

There is speculation that he didn’t report the killings because he was wanting the Thanksgiving search for the kids to lure the father into checking his house.

He had already finished off the kids and put them on tarps for storage, while not reporting anything.

I don’t know which article you read, but they sure wrote more than one article on it, and continue to.

The charge is first-degree premeditated murder.
