In a packed courtroom, 52 year old Ernie Tertelgte told the judge "I am a living man protected by natural law and I have the right to forage for food when I am hungry...You are trying to create a fictitious, fraudulent action."

Charged with fishing without a license and resisting arrest. Mr Tertelgte says he's being wrongly prosecuted for trying to feed himself.

When folks that rule the country lie, cheat and steal it is absolutely wrong to charge this man with a crime!

In law, the rule is:

“Emergency” trumps everything.

The man is innocent. (well, he’s “not guilty”, I’ll need to check Black’s 6th...)

Reminds me of something I saw as a young child. A white berating a black man for something :

Black: I thought this was a free country.
White: Not for you, (n word).

I should have paid more attention to that lesson.

I believe it is called “competing harms.” As in you can’t be trespassing for jumping a fence to pull someone from a burning building.

I follow fish and game laws and me and my 3 boys harvest much wild food each year. But I save zero dollars by doing this and the truth be known I can afford to pay for all the food I can possibly eat.

I hunt deer in an area that is economically depressed. The camp I hunt from is owned by an old college chum who can also afford to buy all his necessities. The guy who lives across the road from our camp is dirt poor. An old vet who refuses to take social security(in his late 60s) or any government assistance. I know he probably has no licenses and eats all the venison and fish he can harvest. Neither myself or anyone else in our group questions his lifestyle and I respect him more for not falling into the whole government as sugar daddy BS.

He is dying of lung cancer and refuses to get any assistance in that area either. I admire his self sufficiency and rugged indepence stance.

My office does the tax work for over 400 horse & buggy Mennonite & Amish farmers. I have so much respect for them. They pay their taxes, but will not take 1 cent from the government. They have no electricity or plumbing in their homes and lead a simple life.

They are about as self sufficient as can be, and rely on God for their strength through hardship. They bend over backwards to help others, whether they are members of their group or not. I know, when the going gets tough I have many friends. Right now I’m paying it forward.

I am a criminal defense attorney in California. We get a good number of these "constitutionalist" types. They have some of the craziest ideas I've ever heard. This guy was yammering on about the "natural man" vs. the "legal fiction" of a birth certificate, which is somehow in their minds equivalent to an incorporation certificate. He's not a "federal citizen." He thinks that lawyers are somehow British agents. It's really way far out there.

Now, I agree that if he was hungry that there ought to be some leniency for his foraging for food, but other than that I'd urge all to stay very far away from this particular type of lunacy. It's like that crazy tax resister stuff. Crazy. Really just barking mad stuff.

When my husband was young and rowdy they were camped next to a foster parent with about 10 boys and one tag for a deer and according to my husband’s jeering derision little chance of ever killing a deer.

My husband was right and the guy didn’t get that much sought after meat until my husband and his friends broke camp and every one of them gave him the deer they had harvested. The guy cried.
