School: 5-Year-Old Committed ‘Sexual Misconduct’ By Pulling Pants Down On Playground

SURPRISE, Ariz. (CBS Las Vegas) – A mother is upset after her 5-year-old son received detention for what his school is calling “sexual misconduct.”

Eric Lopez, a kindergartner at Ashton Ranch Elementary School, pulled his pants down on the playground this past spring. The child received detention and has a note within his permanent file at the school. At the time of the incident, his mother wasn’t notified nor did school officials inform her that her son signed a note in the assistant principal’s office.

“He did not know that he could ask for me,” Eric’s mother, Erica Martinez, told KTVK. “He’s 5.” Dysart Unified School District has a policy that states a parent does not have to be present for a disciplinary meeting unless the student requests his or her parent.

For the past two months, Martinez has been fighting to have the sexual misconduct label removed from her son’s file citing that her son’s actions were not sexual in any way. But the district has denied her appeal and the assistant superintendent is defending the school’s actions.

Get a lawyer. Sue the School District for eight figures. That will get their attention.

If the 5 year old signed the note, then it isn’t legit.

A 5 yr old is not legally able to sign anything. Damn, I hate to say it but they need to sue. These people are unreasonable so suing makes complete sense to me.

At 5, a good case can be made that he can’t READ what he signed, much less understand it.

My younger brother had a friend around his age when he was about 13. The kid was visiting and apparently had gone behind our garage to relieve himself. The area he had chosen was between the garage and a hedge that met the neighbor’s fence.

It was not a terribly tall hedge, but you would not have been able to see him from the neck down if you were in the neighboring yard...unless you were looking from the second floor, which, apparently the woman next door had been doing. She called my mother to complain that the kid was outside “exposing himself”!

My mother, who had already raised my older brothers, knew perfectly well what was going on, and she handled the call well, but she was just astounded at the fact that this woman would react this way because the grumpy neighbor had raised 4 children of her own, and 3 of them were boys.

I did not have any boys, but sister did and my friends did! It seems to me that there is nothing more thrilling for boys then peeing in the great outdoors. Goes for some men I know as well. It’s just a man thing. :)

In my childhood during the 50's, little girls used to pull their dresses up over their heads to show off their underpants. School administrators are by and large morons nowadays.

My daughter had talked with my granddaughter about cats and how they mark there territory by peeing on it. Later on, she was washing dishes and looked out the window to see the little girl up in a tree with her pants down, marking her territory.
