'Honest mistake' leads to Philly mother facing three years on gun charge

A Philadelphia mother of two is facing three years in prison after she mistakenly entered New Jersey, where she was stopped for a traffic violation and found in possession of a handgun loaded with hollow-point bullets.

Shaneen Allen, 27, was pulled over in New Jersey’s Atlantic County after making an unsafe lane change in the early morning hours of Oct. 1. Allen then told the officer that she had the .380 Bersa Thunder handgun, as well as a concealed carry permit for Pennsylvania, unaware that her permit was not transferable to The Garden State.

“The gun charge was not proper to begin with at all,” her attorney, Evan Nappen, told FoxNews.com. “She made an honest mistake.”

Allen, who has no criminal record, was later charged with unlawful possession of a weapon and possession of hollow-point bullets. If convicted, the illegal possession of the handgun is a second-degree felony punishable by a mandatory minimum sentence of three years in prison.

“The officer knew there was a gun there, she was completely honest and open,” he continued. “There’s no aggravating factors in this case; she’s a single mom of two, working in the medical field who was robbed twice and that’s what inspired her to get a gun license in the first place.”

Allen, who could not be reached for comment early Wednesday, had only owned the gun for a week prior to the arrest, Nappen said, and purchased it for her protection after being robbed twice in the past year.

Since I used to get pulled over and searched by the U.S. almost ever time coming from Mexico, I used to make sure that I had a bottle of Ruso Negro and a bag of ice to make drinks, as I sat on the concrete wall and watched Customs and their dogs search my car.

Sad and excessive, but on the other hand if you are going to carry heat ya needs to know da rules.

The only rules there should be for firearms:

Never point a weapon at anything you do not intend to shoot.

Treat every weapon as if it were loaded.

Keep you finger straight and off the trigger until you are ready to fire.

Keep the weapon on safe until you intend to fire.

Know your target and what lies beyond.

If she didn't violate any of those......I don't see a problem.

A simple sign “Welcome to New Jersey” can turn any of us in to felons. Even without a handgun you’re a felon merely possessing a chunk of lead.

Disgusting abuse of citizens by New Jersey.

And just remember this next time that execrable Chris Christie is held up as the savior of the republicans and a potential presidential candidate.

Gun owners like this woman should do what the gays have done that is use the courts to get every state to recognize other states gun permits.

Correction: She was granted the PRIVILEGE. Rights require no license/approval from gov’t

At least that’s the way it used to work, when we were a Constitutional Republic

Faulty writing by Fox News. I think they meant that she mistakenly entered New Jersey WITH A GUN AND HOLLOW POINT BULLETS.

If she was in Atlantic County she did not make a mistake and wind up in New Jersey as Atlantic County does not border Pennsylvania (or any other state).

The refusal of some states to recognize firearms permits issued by another is ripe for challenge in the federal courts I would think.

Heck, you don't have to come from Mexico. I've had dogs sniff my pickup just coming north from El Paso at the ICE station on my way to Oil Patch city.

I’d bet dollars to doughnut holes that they used illegally obtained CCW information from other states to flag her vehicle in hopes of finding a gun in her possession.

What no one has caught yet is that I could sit there on the wall mixing drink after drink in front of the border Patrol, and then when they were finished, drive away.

The Border Patrol was not involved with or interested with state law.

Why is INTENT used to criminalize someone with fertilizer (bomb making equipment) but this same rule is not applied to someone with a gun who has been criminalized in TWICE in the past year?

Law abiding citizen one moment, felon the next.

Only for a specific set of circumstances.

If you can believe folks (and I do), there is no such thing of a law abiding citizen anymore - they have so many laws that each of us commits multiple federal felonies each day without knowing it. Tis is an example of what can happen to any of us should the eye of the government fall upon us - they already have collected ample evidence of our "crimes" and can take us down "legally".
