Eric Garner's death in NYPD chokehold case ruled a homicide

The controversial death of a New York City man who was placed in a chokehold by police was formally ruled a homicide Friday, a move that will almost certainly place the officers in front of a grand jury and heighten tensions between residents and the police department, city officials and policing experts said.

Eric Garner, 43, died after being placed in a chokehold that caused him to suffer neck and chest compressions during his arrest two weeks ago in the Tompkinsville section of Staten Island, according to findings released by the New York City medical examiner’s office. Garner’s weight, chronic asthma and cardiovascular disease were listed as contributing factors.

no, but resisting arrest is....when a person with a gun says thet you are under arrest....STFU and comply with what he/she says....

From what I understand, this guy had been arrested something like 20 times before. There was probably some animosity/grudges involved. And watch the video, at least a couple of the cops are covered in tats, one of them has full leg sleeves — probably not the type of people we want given a badge and gun.

In most states the Coroner/Medical Examiner has only four choices:

Natural
Accidental
Suicide
Homicide

That group of cops killed a man, a USA citizen, recorded on multiple cameras, for “illegally selling tobacco products”.

I can't see any way for the JBT supporters to possibly justify what they did to him.

At most, they should have politely issued a written notice /summons to him to appear before a court.
I don't care if it was his first or 21st summons for the same offense. No where have I seen any indication that he was physically dangerous to anyone in public, or committing anything other than regulatory “misdemeanors” .
He wasn't robbing anyone. He wasn't threatening anyone.He wasn't armed with an illegal weapon.

If anyone has any factual information that claims otherwise, I'm certain we would all love to learn of it.

But as of today, I have seen nothing but a bunch of cops killing a USA citizen, because they just didn't like his attitude against an unreasonable attempt to physically detain him for a regulatory infraction.

Why did they attempt to physically detain him?

Hand-in-hand with the ‘I was in fear of my life’ when reloading 3x filling the ‘perp’ w/ lead.

Should be changed, there is no ‘immunity’ for working w/ the gov’t when one has committed a crime. Keep the taxpayers out of the loop.

grow up, we hire these people to maintain control. If they harass you, you have recourse through the legal system....but when they say that you are under arrest, they have the right to shoot you if you do not comply....STFU and take your chances in court.

statist???, I don't think so, but we have a choice as to who is in control of our community...the authorities who we hire, or the thugs who have no responsibility to anyone....like they have in Chicago.....I'll take the cops...

The autopsy found that Garner died as a result of compression of neck, compression of chest and prone positioning during physical restraint by police.

Section 203-11 of the NYPD Patrol Guide is clear:


“Members of the New York City Police Department will not use choke holds. A choke hold shall include, but is not limited to, any pressure to the throat or windpipe, which may prevent or hinder breathing or reduce intake of air.”...
 
“... may result in both criminal and civil liability.”

“EXCESSIVE FORCE WILL NOT BE TOLERATED”
