Let’s Make Judicial Impeachment Great Again
Daily Caller ^ | Feb 23, 2017 | Thomas Wheatley

Rep. Bob Goodlatte (R-Va.) is in a prime position to make history.

Goodlatte, who represents Virginia’s 6th congressional district, is chairman of the powerful House Judiciary Committee, a body with broad jurisdiction over the administration of justice in federal courts, administrative bodies, and law enforcement agencies. Congruent to the committee’s mandate is the House’s exclusive power to initiate impeachment proceedings against federal officials having committed “high crimes and misdemeanors” under Article II, Section 4 and judges running afoul the “good behaviour” requirement of Article III, Section 1 of the Constitution.

Given the scandalously wrong decisions from judges in the Ninth and Fourth Circuits over Trump’s recent executive order on immigration (I will not rehash here why these decisions are wrong—mostly because legal scholars surpassing my acumen have already done so hereherehere, and here), Goodlatte should consider dusting off his impeachment authority to remind these inferior courts of their constitutional role.

He’s right of course, but with the near total control of the media and the near total ignorance of the general public - especially the snowflake crowd, such a move will only add fuel to the fire and be seen as something it is not. If tried, who will step up and give the civics lesson?

I think we are pissing in the wind to think Congress or any part of that body, will ever, anymore, at any time do the Right Thing and Punish Anybody who is “superior” to them or may themselves pack a wallop larger than theirs will ever impeach a JUDGE. Why? Aren’t JUDGES sacrosanct?

Congress isn’t policing their own ranks unless it is against a woman on a rant (think Warren). But pedophiles (think Hastart) or traitors (think McCain) and Judges (9th District Court) who don’t have a clue about what the Constitution means and how it is used for the good of the people (who are citizens of this country), are never brought into line(think impeachment and/or removal from office) Now why is that?

Lifetime appointments with zero accountability are the surest recipes for the corruption that has infested the federal judiciary for decades. If the branches are truly equal, they should have equal terms of service.

What is needed is to flood Rep. Bob Goodlatte’s office telling him to “DO YOUR JOB”

nothing will get one judge’s attention better than seeing other judges losing their jobs for having put politics above the law in their decisions. Way over due and needs to include the SCOTUS, Roberts.

Trump needs to end the tradition of allowing liberal senators nominating new federal judges. There is no law requiring it.

The only impeached federal judge I can think of is Alcee Hastings and he is now a member of Congress.

This is the necessary check and balance on judicial Tyranny.

If Congress never impeaches, either we live in a Utopia or Congress is derelict in their Constitutional duty.

Congress is derelict in their Constitutional duty.

I thought that was obvious.

Re:"under Article II, Section 4 and judges running afoul the “good behavior” requirement of Article III, Section 1 of the Constitution."

It's worse than that - in that the liberal element within the Judiciary have clearly demonstrated that they are a subversive entity. And, if the Judiciary as a whole is unable to neuter the misfits within their ranks, then the Judiciary itself will have become a subversive branch of government - thereby destroying the constitution and our previous form of government.

The best way to eliminate a whole raft of federal judges is to use a congressional “structural reform” of the entire federal judicial branch excepting the SCOTUS.

Not only can this split the onerous 9th circuit in two, leaving its liberals to lord it over just liberal states, with the new, 13th circuit over the red states, but structural reform can basically “eliminate” the courts of the worst of the federal judges.

That is, they will continue to be fully paid until retirement, but they will no longer hear cases or make decisions. They will be stripped of power without having to go through the impeachment process.

The advantage of doing it this way is that it can be done as a batch, firing dozens of federal judges all at once, instead of one at a time. Effectively purging the judicial branch of these radical jerks.

They can then be effectively replaced, in equivalent courts, with good judges.

But structural reform can do much, much more. It can impose new rules on federal judges, require them to disregard old and bad legal precedents, bring about both *criminal* and *civil* legal reform.

A massive rewrite of the branch.

The district court responses to the second EO are nothing more then Soviet Kangaroo court imperiums.

The notion that the judiciary thinks they can simply fabricate excuses to nullify Presidential authority is exactly how the old Bolshevik bully thugs operated.

And it was what we fought against from 1917 to 1991.

The judges involved here ALL need to answer for their criminality, because that is what it is: their judgements were the result of prejudice, already coordinated with Obama’s operatives.

They’ve been subversive for quite some time, they’ve now become blatantly criminal.

Roberts, Kennedy, Ginsburg, Breyer, Sotomayor, and Kagan should all be impeached. The ridiculous ACA rulings and the brazen and illicit Obergefell ruling are absolute garbage, the worst actions ever taken by the Supreme Court, and should be ignored. Do we even need to discuss the idiocy of the recent 9th Circuit opinions?

These people aren’t fit to clean a gas station toilet.

This Hawaii clown is the worst so far. Classmate of Obama. Eats dinner with Obama and then the next day hands down a 40+ page ruling within 2 hours of hearing the initial case (obviously pre-written and fed to him by Obama staff) and files an injunction as though the issue is egregious.

Abuse of office, collusion with applicants, a real clown.

The purpose of Congress isn’t described in Article I.

The purpose of congress is reelection. It is a dangerous Potemkin body in that it pretends to legislative power, all the while it condones lawmaking by the courts and exec branch.
