A federal appeals court ruled Tuesday that a transgender Wisconsin high school senior who identifies as male can use the boys' bathroom.
The ruling, a victory for Ashton Whitaker, 17, of George Nelson Tremper High School in Kenosha, came the same week that he graduates. Nonetheless, he said he was thrilled with the decision.
"I hope my case will help other transgender students in Kenosha and elsewhere to just be treated the same as everyone else without facing discrimination and harassment from school administrators," he said.
A three-judge panel of the 7th U.S. Circuit Court of Appeals ruled unanimously that the Kenosha Unified School District violated a federal law and Ashton's constitutional rights by insisting that he use either the girls' bathroom or a separate gender-neutral restroom in the school's main office.
The court dismissed as "sheer conjecture and abstraction" the school district's argument that its refusal to let him use the boys' bathroom was based on a need to protect student privacy.

If you want to be treated the same as everyone else, don’t make yourself a freak show.
What happens when she goes into the boy’s bathroom and a bunch of real boys give this pretend Peter Pan a Swirly?
I mean, it’s what boys DO! ;)
An ugly boy. An uglier girl.
That is going to be a mess. Since said student still has female plumbing it might pose problems at times using the men’s room. Also it might want to take a can of Lysol and some alcohol pads when they venture in.
What in the Constitution did they base that opinion upon? I am mystified!!
What if they take out the toilets and only have urinals?
What till the next Olympics and dudes want to compete as girls.
And it’s not the only thing boys do...especially when the wrong kind of boys find a bio female in an unsupervised area like a bathroom. Or will the school have to send a male teacher or staff member in to oversee this girl’s restroom usage?
Doesn't IT have to have a "Covfefe" to use the urinal.
I've never seen a "Efefvoc" able reach a urinal.
I can predict this douche will end up getting raped, or thumped soundly in the men’s room, and then will sue the school because they didn’t protect her properly.
Agreed. It used to be a "live and let live" type of society; however, these people now INSIST that we all have to jump on their crazy train. They now INSIST that we must participate in their same-sex "marriages". There is no more, just let me live my life the way I see fit. It is now --- you change YOUR way of looking at things to agree with mine -- OR ELSE! And, the State/Feds will enforce their will onto you. Honestly, I don't think normal, everyday people have any rights anymore.
You think even the liberal blacks who pushed this in the 1960s dreamed that it would be used this way?
“The Civil Rights Act of 1964 (Pub.L. 88352, 78 Stat. 241, enacted July 2, 1964) is a landmark civil rights and US labor law in the United States that outlaws discrimination based on race, color, religion, sex, or national origin”
Stupid wench...going to the boy’s room doesn’t make you a boy. Just like sitting in a garage doesn’t make you a car.
Only if “he” can qualify by proving that “he” can use the urinal.
The secular toleration of sex confusion is going into younger and younger ages.
The world is changing. Christians and Jews will need to win the world once more rather than assuming defacto command over it.
It’s not discrimination or harassment.
How to get your way: cry discrimination. You can do anything.
If sex is chosen and fluid this is exactly where this goes.
This is the world being... Gasp... Godless and secular and pagan and not even pretending to be otherwise.
In all laws, regulations, judicial proceedings, and publications of the United States, all references to a persons as male or female shall refer exclusively to a person's biological sex.
