The New Jersey woman who lost her husband and four kids in a deadly wrong-way crash in Delaware earlier this month is calling on cops to press criminal charges.

Cops are too busy. They’ll defer to the lawyers in this case. It takes the victims and the media to gang up on them.

Was he drunk? Was he high? Was he texting or arguing with his passenger, distracted? Did he catch roadside movement out of the corner of his eye and reflexively cut the wheel to avoid a perceived threat of collision (I’ve had that one...scary as hell).

Until all the facts are in I’ll withhold judgement. Oh...and, is he of a “protected” class?

Well, what’d he say? How likely an answer was it? What’d this male passenger say? Who is this male passenger to the driver? If I were a reporter I’d report a hell of a lot more than is here...

My initial reaction was the same as Bonemaker, but even with the spin the media is putting on it, it isn’t clear that they have the elements of a criminal case.

Her lawyer needs to come up with some facts that will support a prosecution, not just a theory and emotion.

” pickup truck came speeding over from the opposite lane and struck them head-on.” Sounds like speeding and passing where it wasn’t safe on a two lane road.

Then we get this?

“he drifted over the grassy median and into the oncoming lane.” Still sounds like a two lane road, but one with a divided grassy median?

And drifting or speeding? Totally different image pictures are painted in those two paragraphs. So I retract what I said about a theory - they don’t even have one yet. Just emotion.

The forensic investigation in a case like this would easily take months. It's helpful that there was a passenger in the pickup truck who might give some clues about what happened.

I'm sorry for this woman's loss, but she needs to understand that the police can't just arrest the guy on the spot. For all we know, this crash could have been caused by a blown-out tire, or debris on the roadway.

It takes longer to build a criminal case when the facts don’t merit a prosecution. Look at how long it’s taking Mueller to go after Trump.

And most state crime labs have huge backups these days.

Unless they come up with a high BAC or some other drug (and that will take time to get to and get done), I’d rather defend than prosecute this one. Any potholes on the road? Grooved or smooth pavement? Why wasn’t there a suitable barrier in the grassy median to prevent foreseeable crossover head-ons? Remember the girl in Texas who went to prison because GM covered up the defective ignition design? Maybe there was a problem with the truck. Any other F-350s been in head on collisions or drifted out of their lane?

Emotional jurors like you who want to blame someone? I’d give them someone to blame if the prosecutor wandered in with a weak case. And it sounds like you don’t want to give them time to build a solid case (if there is one to build).

Try watching that LivePD on Thursday and Friday nights.

It’s softening the Public to accept being rousted all the time. What they call a Traffic Stop turns into a search that empties the vehicle damned near every time.

Somebody has “Connections” that was in the Truck. 5 dead and no charges?!?!

I smell a RAT probably a political one. Sort of like biden’s little bitch neice getting a slap on the wrist.

Charges can take time. The DA has to gather evidence and make sure all the T’s are dotted and the i’s crossed. He would not want to screw the case up.

For all we know, this crash could have been caused by a blown-out tire, or debris on the roadway.

Blown tires are usually caused by extreme wear, lack maintenance, neglect etc., and debris in the roadway does not make it OK to move into on-coming traffic lanes, causing deadly head on collisions...So even if this were the case, the person would still be in the wrong and liable civilly and possibly criminally.

You don’t know that it was anything more than some sort of medical episode, mechanical failure or just distracted driving. The truck was not driving wrong way it crossed over at speed. Seems a charge of unsafe movement at a minimum could be made but beyond that is speculation. A lot is not said in this article.

Thanks. Maybe you could supply some facts that the reporter didn’t.

How many lanes each way.

Divided grassy median or not. If so, with cuts for crossover turns or solid? Any barriers in the median (wire, steel, wood or concrete?)

Known for wrecks, or generally safe?

The guy may or may not be guilty (and the toxicology will probably be the determinant) but this story doesn’t even get us to clear and convincing, much less beyond a reasonable doubt.
