As far as The Court is concerned, we plebeians do not have The Need To Know. If it is unfavorable to the Dems, you can bank on a ‘surprise’ leak, maybe from a Wise Latina, you never know.
I was talking about this with a friend today. Neither of us are convinced she is conscious, competent, or capable of carrying out her duties.
If we see her back on the Court and she is sitting up straight then she is probably dead.

The Court will be out on break until 19 February, so she doesn’t need to show her face before then.
The Chief Justice (And Dem leaders) will be checking on her condition, but not making it public. If she still doesn’t show up for work on 19 Feb, then there will be a frenzy of public speculation.
Mental status does not determine her eligibility to remain on the court. She is appointed for life. So long as the body is breathing, even if there is no awareness left, she is eligible and the Democrats will probably ensure that she maintains her seat. At this point she probably can’t decide to retire so she will stay on the Court and issue Opinions through the interpretive offices of her staff.
I agree that she can’t be booted but maybe Roberts could decide that voting by the Justices will occur in person and be expressed verbally with no aides allowed in the room?
