Trump campaign sues Washington Post for libel

President Trump's campaign has filed a multimillion-dollar libel lawsuit against The Washington Post, claiming the newspaper knowingly published false claims that Trump engaged in a conspiracy with Russia concerning U.S. presidential elections.

The lawsuit, filed Monday in a Washington, D.C., federal court, comes a week after the Trump campaign filed a similar suit against The New York Times.

The lawsuit cites two Washington Post opinion pieces from June 2019, one which said that then-special counsel Robert Mueller concluded that the Trump campaign “tried to conspire with” a “sweeping and systematic” attack by Russia in the 2016 election.

A second article stated “who knows what sort of aid Russia and North Korea will give to the Trump campaign, now that he has invited them to offer their assistance?”

The lawsuit, which accuses the Post of harboring “extreme bias” against the Trump campaign and Republicans generally, claims the articles will require costly efforts for the campaign to correct the record.

The defamatory article has forced, and will force the campaign, to expend funds on corrective advertisements and to otherwise publicize the facts that it did not conspire with Russia in 2016 and is not seeking Russia’s or North Korea’s help in the 2020 election,” the lawsuit states. “The campaign was damaged in the millions of dollars, the specific amount to be proven at trial.”

The lawsuit faces long odds in court. To succeed, the campaign will have to carry the heavy burden of proving that the Post’s claims were false statements of fact, and were published with actual malice or reckless disregard for the truth.

Nick Sandmann broke the ice on suing the Fake Media. Now we are seeing the follow up. They aren’t immune for their knowing fake lies.

Sandmann was a very different category of plaintiff.

I hope Atty. Gen. Barr has nothing to do with it.
He will stretch the case out for years, and there still won’t be any conclusion.He would probably write a speech or two about the experience.

NYT v. Sullivan presumes a media that is acting in good faith. Here I assume that it can be demonstrated the NYT and WaPo intentionally fabricated stories without any basis. I don’t think Sullivan should apply to such facts.

What can they do that they haven't done before?
Trump has nothing to lose, save for a few million dollars which is being paid for by the Trump campaign. There is a clear strategy behind this. President Trump hinted there’d be more lawsuits last week.

Even if President Trump loses he wins. The WaPo are going to be forced to admit “The Post’s claims were false statements of fact, and were published with actual malice or reckless disregard for the truth”, which clearly was the case.

I agree, WAPO is easy to dissect here, easy to prove they acted knowingly, fraudulently, to injure the President and his supporters.

The writer is relying on old case law of a different, less open era. The era we live in now, The Great Awakening, is making new case law. There are now thousands more ways to pin malice on persons professing to be journalists for malicious, willful, deliberate injury on others.

The arena appears the same, but the lights are much brighter, the view is clear with angles revealed in every corner and crevice, and the rules have changed.

We have freedom of speech but not to deliberately lie or commit fraud. If the President wins the lawsuit perhaps the bad guys can tossed in jail as well.

Nick Sandmann didn’t break anything yet. He accepted a settlement. I don’t believe he even got a “my bad” from WaPo.

Exactly. And it will come in the lead up to the elections. And you bet Trump will be tweeting about all the embarrassing revelations to come. Its all been well thought of.
And the beauty of it is, Trump didn't sue them. The Trump campaign did. So they can't Trump as a witness. Not that they could a sitting president anyway.

Correct. Until Sandmann’s lawyers take one of these “news outlets” to the mat and obtain a judgment (and successfully defends the inevitable appeals) then there is no case law for Trump’s lawyers to cite.
