If the police had questioned him or he was talking to the press, I might be inclined to agree with you. However, he has done neither. It LOOKS bad but its smart that he lawyered up and shut the hell up. Ive heard my share of crime podcasts where innocent guys have willingly talked to the cops because they had nothing to hide and the cops have gone after them and succeed in putting them in prison.

Yeah, doesn’t look good for him. Good on him for shutting up and lawyering up ASAP. Im not saying he’s guilty or not. Just saying he is doing what EVERYONE should do. Hire a lawyer and shut up. Especially if you are innocent.

The amount of people who willingly talk to the cops after a murder is astonishing. Then cops get tunnel vision and totally focus on the spouse or boyfriend and it can go south for that innocent person so very quick. Once it goes to a jury, anything can happen.

Law enforcement can come up with just about any reason to bring in the family for questioning. As the vehicle has been seized, yes, it may be too late for a GTA charge, but perhaps not posession of stolen property, the vehicle and its contents.
There is an urgency, because the woman may still be alive, but in distress. Each day, each hour that passes makes the urgency grow. The behavior of the family is suspicious and abnormal, and is making the situation more difficult.
If you’re innocent let the judge decide. If you’re guilty let a jury.
What if he doesn’t want to “come in” as you say? You gonna make him?
How do they prove the vehicle was stolen? She is not available to testify that it's in his possession without her permission. Police and prosecutors need to operate on proof not speculation.

LE can't just "bring in" people for questioning. They can ask a person to come in voluntarily, which can be refused, or they can arrest the person and bring him or her in. An arrested person can also simply refuse to answer. "Talk to my lawyer" immediately ends any questioning. There is no theory on which anybody involved in this case could be compelled to talk to the police.

How can one be charged with possession of stolen property if the police have no proof that the property is stolen?

Do you know How, Legally the vehicle was seized by the police when the registered owner is missing?
It was seized because the legal owner, likely one of Gabby’s parents, gave them permission. Otherwise they would need probable cause, which they clearly don’t have otherwise they’d have brought Brian in for questioning.
As for the vehicle being “stolen”. Knock it off.
Did Gabby call the police and say “I did not give Brian permission to take my car without me or take it out of Utah”? Then it is not stolen. Brian is clearly on video in the driver seat with the registered operator, Gabby is in the passenger seat. He is likely on the insurance policy as well. Clearly Gabby gave Brian permission to operate the vehicle and indication is on video. So it is not “stolen”. Just knock off all the jumps-to-legal-conclusions. It’s insulting to those of us who respect the law and have an inkling of how it works.
