Nevertheless. RvW was bad law since it created rights out of thin air. Yeah, you have a right to privacy, somewhat — yah don’t get to keep your prison in the basement private.
But, privacy is not equal to murdering a baby conceived by two people. Everyone gets a vote. That is not privacy, that is unilateral control — emphasis on latter.
If RvW is overruled because it was void to begin with, then any other right created out of nothing is also vulnerable. That, however, does not mean said “right” can be reversed. Reversal needs something else, something/one having been harmed by creation of the right.
For abortion the harmed parties are the sperm donor (not Dad, a dad would show up) and the fetus.
Who is harmed in the other circumstances?

What the five supposed signers of Alito’s supposed opinion have agreed on is more, much more, than overturning the Roe and Casey decisions. They are agreed that the US Supreme Court has to stop making shit up, and that NO decisions which relied on their non-existent power to make shit up are safe.
Alito, in the draft, was very, very clear about this, and it’s THAT which has the Left so riled up.

The Babylon Bee would have fun with this one, writing an article about “Clarence Thomas wrote the opinion on why interracial marriage was an abomination and should be immediately banned. Immediately after the verdict, DC police arrested Thomas for being in an interracial marriage, based upon his opinion.” Of course, I don’t make the Big Bucks like the Bee, so they could do a better job of this.

Interracial marriage is a civil right protected by the Constitution. Abortion, gay marriage, and sex changes are not.

The simple fact is that Scarborough is completely mistaken. Abortion rests on a series of decisions that were themselves based on nothing in the Constitution or prior American law. Those decisions on which Roe stood are complete garbage, and the Supreme Court finally had the guts to reverse that nonsensical bit of social engineering. Abortion involves the right of an unborn human being to live, based upon whatever each individual state decides on that issue. In other words, it is not a federal issue, but one for the states to decide. That is what federalism is all about. There is literally zero authority in the Constitution for the federal government or the federal courts to decide this issue.
On the other hand, interracial marriage is about what two consenting adults decide to do in terms of their relationship with each other. There is no innocent life to be protected, and the simple fact is that marriage is the business of the federal government to some extent, because people have moved from one state to another since before this country was even founded. There is no way that you could have a valid marriage in one state and when that couple crosses an imaginary line from State A to State B, suddenly their marriage is no good anymore. Further, there are all kinds of laws on the books on the federal level that prohibit discrimination based upon race. So the simple fact is that even if Justice Thomas wanted to reverse interracial marriage as a matter of his personal preference, on a constitutional basis he would not and could not do so. Nor would any of the other justices. That would be in 9-0 decision against invalidating interracial marriage. Morning Joe is as stupid as Slow Joe.
