Women are born with wombs, men never are. Men cannot have babies, it is a biological impossibility. When a nurse records the birth weight, length and sex, she is not forcing a construct on a child. She is using science. Weight, sex and length are measurable and CANNOT BE CHANGED.
Good points. These liberals lecture us that they are following the science, such as with global warming. What about the science of the sex of a person? Isn’t that science?
I know the liberals talk now of women as people who were “ASSIGNED FEMALE AT BIRTH”, OR “AFAB” for short. They say that one is assigned a sex at birth. The implication being that someone made some arbitrary decision upon birth, that a baby was either male or female. They make it sound as if there was no evidence to see if a baby was a male or a female. They make it sound like it was a roll of the dice to decide if a child is male or female.

Amen to that. When she starts to come out and vociferously defend her political opposition’s right to free speech, and attacks the lies her side perpetrates (e.g. slander and libel about racism, xenophobia, etc) maybe I’ll take notice and ask her what took so long.

It’s an interesting legal test as to whether the First Amendment actually strengthens your rights as opposed to the vaguer definitions of English common law which is the foundation of law in most Commonwealth countries like Canada and Australia, New Zealand etc.
I am not convinced there is much difference. The test is what you can say and not face legal sanctions. For example, that Christian couple in Portland OR who did not want to serve lesbian customers by baking them a cake had several years of legal problems before getting a clearance based on their first amendment rights.
I am not sure if there has been a parallel case in a commonwealth country, and I am not convinced that you would face legal problems any differently with perhaps the same eventual outcome.
In Canada, as I know from my own court experience, the parallel to the first amendment is that defamation is not against the law if (a) any reasonable person might hold the opinion, or (b) no damages to reputation can be proven.
In the case that involved me, I was sued for defamation when I said that a certain individual was supporting terrorism by supporting an individual widely accused in Canada of being a terrorist. The judge in that case found that while there had technically been defamation, my opinion was one that a reasonable person could hold (public opinion surveys were introduced into evidence). Also there was an indication that the context, an exchange of views on several internet forums, was such that very few people outside of the echo chambers of those forums would pick up on the negative opinion, nor would very many people suppose that just because a person posted an opinion on the internet, it would somehow carry a lot of weight relative to a person’s reputation.
In fact, insults are specifically listed as exceptions to slander or libel in British common law. So if you were overheard in a pub saying “Trudeau is a commie ba*tard” or even something worse, if it had the general meaning of being an insult and not an analytical statement, then it would not be eligible for legal retribution.
The weaker side of Canadian legal protection is the slide towards “group rights” and rhetoric about balancing individual freedoms with the rights of groups. That is something that a more specific First Amendment sort of approach can nullify from the first instance.
Any scholarly analysis I have ever seen of Canadian libel law has said that it is evolving through this internet era and that there are no broad general principles of the law being too loose or too strict.
As with anything else in life, politics is a big part of the equation. If you libel one set of people with friends in high places, you’re more likely to face legal challenges than if you libel unpopular people (like Christian conservatives, who have taken plenty of verbal abuse in Canada in recent years, but are not prone to using lawfare tactics anyway — leftists are well aware that we are counselled by a very high legal authority to turn the other cheek).
