She should not get away with blaming her massive destruction on others.

Agreed.

She was the one who got into the car, started it and drove.

Everything that happened after that point is on her.

Bars lose these type of lawsuits all the time and might also face criminal charges if there is any evidence they served a clearly intoxicated person. Usually these are not big enough cases to make the news.

If someone is stumbling, etc it is 100% illegal to serve them in most jurisdictions nomatter how much they beg. Just need a video of it and slam dunk case.

Some times the liability may fall on the bartender themselves if the bar proves they trained to avoid overserving and the bartender did not follow this procedure

The bar’s responsibility was to cut her off and tell her to leave. It’s her responsibility to get a cab, uber, public transportation, walk, or crawl home. Case dismissed. Plaintiff to pay defendant’s costs and attorneys’ fees.

More importantly she is the one who chose to get intoxicated on booze and/or drugs. So-called “Dram shop laws” are just stupid politicians inserting themselves for the most part, on the part of the trial lawyers probably.

“I was drunk” has never been a defense for the last several thousand years, but, it is 2023 so who knows.

Most politicians are failed lawyers who couldn't make it at the courthouse. So they work for successful lawyers who finance their campaigns and tell them what to do.

No, you're wrong! Apparently, in Canada, the bar is responsible for ensuring that its customers get home, and are tucked into bed safely.

According to the CBC, Leis and her father are accusing Ovations Ontario Food Services of having no regard for her "intended mode of transportation as she existed [sic] Budweiser Gardens when they knew or ought to have known that she was or appealed [sic] to be intoxicated and/or impaired."

Who would have guessed?
