Illinois State Appellate Court to Rule on Constitution Party Ballot Access Case

The Illinois First District Appellate Court has received briefs from both sides in Constitution Party v State Board of Elections, 1-10-2813. The issue is whether the statewide candidates of the Constitution Party will be on the ballot. Under the ruling of the lower court, the party has 24,920 valid signatures, and it needs 25,000.

One issue in the appeal is whether to count the 82 otherwise valid signatures collected by Rosanna Pulido. The lower court did not count them because Pulido was a candidate for U.S. House in the February 2010 Republican primary. The law is ambiguous on whether someone who was involved with a primary petition is free to circulate for a different office, for an unqualified party, in the general election. In the past, the law prohibited individuals from circulating both types of petition, but the law has changed since then. Also, earlier this year another State Appeals Court ruled that Steven Rauschenberger could be a Republican nominee for State Senate this year even though he had voted in a Democratic primary in 2009.

Then he should have ran in the Republican primary... in a Tea Party year, there’s no excuse for this kind of self-defeating third party run. Of course, the Dems will “help” him get on the ballot.

Thats BULL. There is every reason to run anyone who wishes to, and more so when the 2 parties are running pro choice liberals.

The electoral process does not exist for the benefit of the 2 more famous parties, or so you can get your favorite candidate in, altho, if you read a site like this one, I have trouble understanding why you would support Kirk in the first place. If you do. Maybe I misread?

Seeing who the GOP is putting up, I doubt he would have gotten anywhere.

Also, there are many of us who find the economic stance of the GOP to be, uh, less than desirable, even in the things they promise to do, not to mention the things they actually do.

The GOP, I am guessing, is about had it. As I keep mentioning to people who are upset at Murkowski or Castle for not endorsing the seemingly more conservative candidate who wins, what kind of person would vote for either a Murkowski or a Joe Miller, depending on who won the primaries? A person who was more concerned about partisan politics than actual real issues.
