Here's a link to the minute order from yesterday's hearing. It clears up the confusion on the jurisdiction of the court regarding the tapes, etc. It basically says that the court has no jurisciction over the matter until there is a dispute and since the evidence has not been presented there is no problem. The court will have the jurisdiction to rule on the matter when and if it is necessary to rule, at least that's what I get out of it.

Oh, okay. That makes sense. Conflict comes up, one side (in this case the prosecution) backs off, there's no more conflict, so there's nothing for the court to decide.

I'm not saying this is a permanent "back-off" by the prosecution. I'm sure they are getting ready to defend their wiretaps, etc., at a later date.

But anyway, this no longer looks like it means there will NECESSARILY be a different judge at trial. I know where Nancy Grace got that idea, though--generally, the trial judge is different from the prelim judge. I guess we shouldn't sweat it. If they keep Girolami, fine. If they don't, maybe they'll just get another sensible, cautious judge.

That's true, I was surprised to read that Girolami would be keeping it.

Also from the minutes, Judge accepts the FBI expert DNA's testimony pending the defense expert on the subject, motion to strike is pending. Any bets that no expert appears for the defense? Seems like it would be a terrible waste of money to hire an expert that could be easily refuted. Especially with no jury to confuse...

Although I feel like a dunce. I was thinking KNDU was a talk radio station and that Ted Rowlands was the talk radio host.

Wasn't there a local radio station that everyone was talking about hearing in the beginning of this case?

Or was that in the Westerfield case?

CTV - Update Geragos grilling FBI expert. His objections are that this particular DNA testing is: 1. An exclusionary process. 2. Process is debated in scientific community.

CTV guy says that Amy or the maid may make it in today.

CNN - Update. Peterson's DNA expert will be in court on Monday. Court will decide if the hair will be admitted after hearing that testimony.

In the third paragraph of this article from Oct 25th,must be the ruling from Girolami, that he wanted to wait until the pre-trial motions to hear evidence on the Kelly Frey 402's (other than the DNA) and the Frank's Hearing(on wiretaps). Is this how you both interpret, Girolami is proceeding on these special hearings?

I doubt salt water would actually "bleach" color out. It would change it to an ugly greyish orange. Her pants were cream colored and I thought had a pattern on them.

There was. I remember the talk about the radio station. We would need to ask some of the locals (or "sort of" locals) what radio station they used to talk about way back, early in the year, regarding this case. So I've added their names as addressees to this post.

What was the radio station y'all listened to early on when this case was all over the place, in early January?

Check out the press update site. There's a minute order on there, from yesterday. With the help of RGS, we have figured out that the judge did not "reach" the issues of the GPS and the wiretap affidavits (Franks hearing issue).

The reason the judge did not reach these issues is b/c the prosecution stepped back, saying they are not going to use any wiretap-gathered evidence, nor are they going to use any GPS-gathered evidence, at this preliminary. So once they said they wouldn't use that stuff, that means there is nothing left for the judge to decide on those matters. Until, of course, the state DOES start to try to introduce that evidence. So nothing will happen on those matters--no hearings, no nothing--at this time.
