PETITION TO REMOVE GUARDIAN

AND TO APPOINT SUCCESSOR GUARDIAN

Petitioners, Robert Schindler, Mary Schindler, Robert Schindler, Jr. and Suzanne Schindler Carr, by and through undersigned counsel, pursuant to Fla. Prob. R. 5.660, hereby petition this Court for its Order removing Michael Schiavo ("Schiavo") as Guardian of Theresa Marie Schiavo ("Terri" or "the ward") and appointing one of the ward’s siblings, Robert Schindler, Jr. or Suzanne Schindler Carr, as successor guardian. Any one of the statutory reasons set forth below is sufficient to require removal of this guardian pursuant to § 744.474, Fla. Stat. In support, Petitioners say:

I don't know why nobody's posted this as its own thread; it certainly seems worthy. The hearing is scheduled for Wednesday, but the web site doesn't say the time. Key observation: at the time of the last guardianship hearing, Michael and Jodi had not moved in with each other. Lewd and lacivious behavior, including cohabitation, is explicitly forbidden by guardians per Florida statute (cited in the petition above), and I don't think anyone can reasonably deny that Michael and Jodi have been cohabiting for some time and such cohabitation has been of a sexual nature (evidenced by Michael's children).

[PS--I hope this posts right; the preview window shows it being too wide, but it's funny that way sometimes.

I'm sure there will be many who will be interested in how this pans out. FWIW, I'll be praying and fasting tomorrow if anyone would care to join me.

This is a top-of-the-line petition. Yet, why I am I pessimistic that the FL court will not even bother to read it?

FL COURTS ARE CORRUPT!
People should start bumper stickers saying such. We should undermine this judiciary at all costs.

Yet, why I am I pessimistic that the FL court will not even bother to read it?

Under Florida statutes, guardians are forbidden from doing certain things which would not otherwise be legal, including lewd and lacivious cohabitation (except between married people). Unless Michael and Felos can convince a court that Michael's children were not produced by lewd and lacivious means, it would seem difficult for a court to deny the petition. Of course, I wouldn't be too surprised if a judge ruled that reproductive sex was not lewd and lacivious--such a finding would go along with all the other findings of fact in this case.

Maybe it was filed last year and Greer has been rubber-stamping motions to continue by Felos? Could it be that this is the first hearing of the Nov 2002 petition?

I certainly hope they remove him as guardian and that they do not appoint one of his cronies as guardian. Let's hope and pray that guardianship goes to the Schindlers.

Oh, I remember now, Greer scheduled Terri's DEATH for October 15th, (+roughly 10 days),
and he scheduled her GUARDIANSHIP HEARING for 20 days AFTER that!!!

Greer is human garbage hiding behind a black robe.

Well, I don't think the legislators would have expected anyone to be living with a mistress while retaining guardianship of his wife. But I see no reason why the statute should not be applicable here.

And I don't see why it should apply. There's been no suggestion that Schiavo has been sleeping around or leading a scandalous life. He has formed a long-term committed relationship with one woman, who he intends to marry. I understand that some people have a problem with him doing this while his wife is still technically alive, but I don't think you can view this as adultery in the usual sense of the word. More importantly, there is no chance whatsoever that his behavior, no matter how outrageous, will corrupt the morals of his ward, which is almost certainly why that clause was included in the statute in the first place.

Heavenly Father, we return to give You thanks that Terri's family again will appear before the judge in their petition to have Michael removed from holding sway over their beloved daughter. We look to Your word, Lord ... time and time again, the woman appeared before the judge and asked for relief, but he would not grant her request. She would not be silent but kept returning ... so much like Terri's parents who have petitioned the court numerous times over these many years. Because the woman would not give up, the judge granted relief, to silence her lest she wear him out.

O Father, how we long for this judge to have a change of heart ~ may he have genuine fear that he must act on the merits of the petition and grant relief, lest he continue to be cast in so unfavorable a light. Sustain and encourage the Schindler family, for their request is the obvious protection of their daughter. Do not delay this justice, I pray ... may such heavy conviction weigh upon this judge that he can do nothing but grant relief.

Father, I pray that this proceeding and the ruling would reach the people far and wide .. may it be repeated and printed across the nation, such is the peril that has befallen the less able. Thank You that the presence of the forces of evil are being talked about as fact, and not fiction. Continue to reveal to us the very depths of depravity that has taken hold of men, who now use charm and wit and beguiling tongue to deceive the people. Father, may their tongues become as the most vile instruments, dripping evil in such magnitude that its filth can so openly be seen ... may these words become testimony against them .. let them become their own judges. Banish them from the scene, I pray, dear Lord, lest they continue to infect the people with their poison. Turn back all plans upon them .. they who wish death upon the innocents, may they receive their just punishment.

Creator God, I thank You that You continue to use a small group of ordinary people who stand against all the forces of hell. They do not have wealth or power, yet their cause is noble and just. Give to them the small, smooth stones as You did to David, and may these dedicated people slay the giant who seeks to put to death the most vulnerable, for they go into battle under Your banner, Lord, for the least of these, our brethren.

Guard Terri in every circumstance, I pray, for there are those who will stop at nothing to end her life. Soften the hearts of those who care for her ~ may they know that the eyes of the world are upon this mother's child ~ may they treat her as they would want to be treated ... with love and tenderness.

Thank You, Father, for knitting our hearts as one as we pray and work for Terri's release into the loving arms of her family. You have sustained her these many years, and we praise You. Free her from this prison imposed by one who had pledged to love and care for her, for we ask in the Name of Jesus, Amen ...

It should apply (1) because it's IN the law; (2) because any sane person would conclude that a guardian living in sin is not conducive to the best interests of a disabled spouse ward who would prove very inconvenient to the guardian if she recovers. "Sane" is the operative word. It appears to leave out the trolls and Judge Three-Divorces Greer.

Thanks for the nice hello. I've been reading these threads for a long time. I've taken care of a number of patients similar to Terri, in their condition, and I am appalled that someone would try to kill her. I'm also outraged that she's had no therapy, that is an outrage.

There's been no suggestion that Schiavo has been sleeping around or leading a scandalous life.

Most people still consider open adultery to be scandalous. Few here would have any problem with Michael seeking a divorce, but to have children by Jodi without first divorcing Terri is scandalous.

Terri Schiavo case in court again today

There could be some major changes in the Terri Schiavo case today.

Judge George Greer has scheduled a hearing to dismiss a petition from Schiavo's parents. They want to remove Terri Schiavo's husband, Michael Schiavo, as her guardian.

The hearing is scheduled for 2:30 p.m.

This is a different guardian issue than the one ordered by the new "Terri's Law."

Terri Schiavo is the Pinellas woman who has been in what some doctors call a persistent vegetative state since 1990.

We should all pray to not only ask the Lord to soften the heart of that judge but to open his mind to the truth of what has happened here.

Removing the HINO not only saves Terri but mutes the fight over Terri's Law, ends the writing of Felos (felon) book, saves the remaining funds available for Terri's rehab, and allows the Shindler's to sue HINO for all past grievances against Terri and the family.

Should the Schindlers be named as guardian, their attorney should IMMEDIATELY file for divorce on Terri's behalf. Let HINO use his own money for legal services (if he can get someone to represent him) as Felon will be long gone once the money is long gone.

For anyone who is not already aware of it, there is a bill on the table in Florida, being discussed yesterday and today; that would eliminate "lewd and lascivious behavior" as a disqualification for guardianship. Coincidence that it just happens to be on the table TODAY? I, for one, would like to know what brought this to their attention and why they chose today to address it. Will the vote be a done deal BEFORE the guardianship hearing this afternoon?

Michael could easily have gotten a divorce, married his shackup, and at least legitimatized his children. He has refused to do this.

I have little faith in Florida courts after they took chldren away from their biological mother and handed them to an unrelated female who claimed to be a man.

This is not like a murder case where a lot of us get outraged.

Terri's supporters read these threads and IMO it does no good to incite trolls just ignore them or reply with few words to make a point if they are spreading lies.

I am embarressed while so many are advocating for Teri that the thread games go on.

Thread games can be fun but have an appropriate place/topic.

In this instance a woman fighting for life is involved. It really reads bad to see advocates lowering themselves to the level of disruptors.

Please think about it.

Prayers continue for Teri.

I briefly got on earlier today, and wanted to let you know that I saw your post. I thought your idea of saying a rosary was a good one, so when I took my son to the doctor for a check-up I said it silently while waiting for the doctor. The timing was very nice. Started at 2:15 and finished around 2:40. Figured the trial was going on by about then. Does anyone know anything about the outcome yet?

Although I know it doesn't ever seem to go Terri's way in Judge Greer's courtroom, I still believe that there is a chance, because God is more powerful than Satan. Perhaps Greer will tire of the Schindler's many requests and finally give them this opportunity that they so deserve.

CLEARWATER, Fla. -- A state circuit judge Wednesday refused to block an effort by the parents of a brain-damage woman to try to get her husband removed as her legal guardian.

Attorneys for Michael Schiavo now have to respond in court to charges in the petition that he withheld proper care and therapy from his wife, Terri Schiavo, and that he has a conflict of interest because he's in a romantic relationship with another woman.

Bob and Mary Schindler, parents of Terri Schiavo, asked Circuit Judge George W. Greer to appoint Terri's brother or sister as guardian instead.

Schiavo had asked for the Schindler's request to be dismissed, but Greer refused.

In the past, Greer has repeatedly affirmed Michael Schiavo's legal right to remove Terri Schiavo's feeding tube and allow her to die, as he says she would have wished.

The guardianship issue is a sidebar to what is likely to be a major legal battle over a hastily passed state law that let Gov. Jeb Bush order the reinsertion of Terri Schiavo's feeding tube Oct. 21.

Michael Schiavo's attorney, with backing by the American Civil Liberties Union, has challenged the constitutionality of the law.
