But I've noticed when I use the spell check that it takes the < p > part out when ever I try to make a post
Is there any way to fix this?

It's a smallish flaw in the current spellcheck code. It is only removing P and BR when they aren't necessary. If you have no other HTML in your post, your whitespace will be preserved.
