Father allegedly raped daughter

A Spring Hill man remained in jail Wednesday afternoon for allegedly getting his 14-year-old daughter drunk and having sex with her after she passed out.

The man, 38, whose name is being withheld to protect the identity of the girl, turned himself in at the Maury County Jail Tuesday.

The alleged incident occurred on Sept. 17 when the girl, who lives with her mother, made a weekend visit to her father's home, Spring Hill Detective Katie Felton said.

The girl reported the alleged rape to police nearly a month later, the detective said, because of the mental anguish she suffered.

"It being her father - she was very upset," Felton said. "She had a lot to think about."

Felton said the girl was alone with the man at his Spring Hill home when the man supplied her with alcohol and eventually had sexual intercourse with her.

A warrant was issued Dec. 5, the detective said, and the man turned himself in after sheriff's deputies informed him of the charges.

He remains in jail on charges of statutory rape, incest and contributing to the delinquency of a minor in lieu of bonds totaling $102,500.

Under Mosaic Law, a false accuser suffered the penalty they attempted to impose on the innocent person.

How in the world does one prove this case one way or another? The girl apparently was passed out at the time, and presumably any possible physical evidence has disappeared in the month since it supposedly occurred.

Short story . . . a "friend's" niece was raped by her father. Declared not guilty at trial . . . but made the mistake of admitting it to his wife who couldn't testify against him . . . begging for her forgiveness. He was drunk, he said. He was stoned, he said. He had a momentary period of insanity, he said.

Bye-bye, jackass, she said. She's his ex-wife now.

Man enjoyed a week of freedom before three law-breaking, scumbag vigilantes retro-fitted him so he could sing tenor with the Mormon Tabernacle Choir.

The vigilantes have never been caught or tried. Or identified. Scuttlebutt has it that they all suspiciously resembled the mother's brothers.

The pervert moved from Texas to California . . . as soon as he was moved from intensive care.

Not one single telephone call has ever been made to "Crime Watchers" to try and collect the $1000 they offered to help solve the "crime."

It is an extraordinarily insidious accusation. And you put your finger on it: How DOES one prove either guilt or innocence?

Is this a ploy by the mother used against the father? Does the child have serious emotional issues? Is the father really the sub-human an act like this would prove him?

Without proof, there can be no legal resolution. But simply because it was THIS accusation, and not, say, embezzlement, many will have already decided whether this man is guilty or not.

Another "victory" for PC.

Not to worry. The Texas Supreme Court will remove all sex crimes from the books and you'll be able to do anything to anyone as long it is in the privacy of your own bedroom.

But wait! There's more! In five years 'perversity' will be re-defined as 'diversity' by the Mass. Supreme Court and you'll be able to claim tax and financial benefits by 'marrying' whatever aperture, device, man or beast you become fixated on. :<

She certainly may testify against him. She can't be compelled to.

The relevant point is that he had been acquitted. Can't be retried. Double jeopardy and all that.

She certainly may testify against him. She can't be compelled to.

It wasn't a spouse against spouse issue. The daughter was alone with the father because the mother was in the hospital for cancer treatment. In pre-trial hearings, the judge ruled the confession couldn't be admitted because of . . . get this . . . all the "hallucigenic" drugs involved with her treatment.

I tend to be long-winded and I tried giving the Cliff Notes version . . . I apologize for leaving this out.

And this wasn't the only "evidence" tossed either. The girl's "soiled" underclothes were tossed because the crime lab "mishandled" the evidence. And part of her testimony was tossed . . . but I don't remember why. Like most rape cases, the deck is often-times decidedly stacked against the victim -- especially when it's a young victim.

In all seirousness, if this scumbag did what he is charged with, he deserves nothing better than the chair. Too bad he will probably get a few months in jail and a fine/probation.

You're right about the double jeopardy.

But he's lucky he didn't tell the wife before the trial. In most states, spousal privilege doesn't apply to domestic abuse cases and the spouse can be compelled to testify.

In this particular case, its hard to get a conviction when the witness is passed out and waits a month to come forward. Even if there's evidence that the poor girl has been assualted, It would be hard to come up with evidence that points to the dad being the assailant. Hopefully a guy this sick (if he did it) is stupid enough to have confessed to someone.

If he is convicted, he won't last long in jail.
