It's pretty clear that this isn't about smoke. The plaintiff is an egregious and transparent liar on that point. It's really about smoking.

You can exclude pets, cigs, waterbeds, as long as you apply the restrictions to everyone. DO NOT refuse to rent to people with children, unless you are running a senior citizen community. It is against federal law to discriminate based on familial status.

You're right. We enjoy it or we wouldn't do it. For me, the drinking "wasn't working" anymore. I got help in 1985 and that was it.

That's right! If I couldn't stand smoking anymore and I it started to stink to me, I would quit! I've had prescriptions that didn't help me, so I quit them. Why put something into your body that you don't enjoy or that isn't doing any good.

A lot of my dear friends love beer. And these anti's in here never talk about "beer breath." To me, it's horrible, but I don't get on a soap box telling my dear friends that they have BEER breath! We have to learn to tolerate people more. Never had this problem when I was growing up. I just hate this anti-propaganda. And so many people have bought into it. :(

I think people can be accomodating, but there IS a limit. This reminds me of schools that outlaw peanut butter because one kind is allergic to peanuts.

MAINE did this. In down state Maine, one in out of the whole school was allergic to peanuts. So..........the school banned peanuts. Can you imagine???!!!

I have two homes. A condo in the city; a house in the mountains.

In my condo halls and sometimes wafting into my apartment, I smell cigarette, pipe, cigar smoke, cooking foods, burnt foods, chemical sprays...in the garage, I smell exhausts from the cars...and because I live on a waterway, I smell fumes from the boats passing by.

At my house in the mountains, I smell all kinds of things that my neighbors choose to burn...many things that would be banned in the city.

The worst is people who wear colognes, perfumes and after shaves.

I am chemically sensitive and most all of the above make me sick. I would love it if you would help me sue them all so that I could breathe fully once again. If you agree, please send $1000 to the People for the Ethical Treatment of Humans, c/o debg at FreeRepublic.

She rents and smoking isn't allowed in the unit.A lot of smokers would ignore this rule but she's apparently a good tenant.

The problem is that she should be allowed to smoke in her own dwelling, especially since she rents from an absentee landlord. Then her neighbor wouldn't see her smoking and wouldn't know about it, for the most part. When a tenent moves out, the smell of tobacco goes with them, their furniture and possessions.

I could understand a no-smoking rule if you rent an apartment in someone's house, but not in what we call "garden apartments" in this area.

I found a recording of loud applause, catcalls, and whistles and cued it up on my stereo, cranking the volume to about a 6 (which was still enough to be heard). Every time the headboard finished rattling, I played the tape

LOL!!! What a great idea. All we used to do is bang on the wall and say "give it a rest, already"!

Yes, it is. Smokers seem to have this insane need to assert that it is their right to bother other people with their fumes. And in this particular case, the smoker seems to think that her right to smoke is more important that the (apparently real) harm it causes the neighbor.

Her right are as important as a that of the fanatic

I hate to say it tpaine (since I agree with you on many issues), but you sound like a lunatic nutcase here. The case is closed when the courts say it is. The court system is set up under guidelines and laws established by the various constitutions and the precedents of the higher courts in each jurisdiction, and the applicable legislation and regulation of the governments in each jurisdiction. You have no say in the matter at all. You simply don't count.

BTW, I am an ex smoker but have always favored 'smokers rights' and the rights of private property owners to dedide on smoking in their establishments since it is a legal activity. The constant absolute boorish self centered in your face 'screw you' attitude I see expressed by so many FReepers, and smokers in general, has changed this. I am now leaning toward outlawing smoking in any public place; at least I no longer activily oppose such legislation.

Suppose the guy's health really is affected by her smoking -- which is entirely likely. What's your answer then?

She is inside her home, and his health is compromised outside.............. give me a fr...ing break.
