I was going to be really peeved that a poll like this even exists. Then I saw the options and I think it is great, given they don't even give an affirmative option.

Gee... no room for dissenting opinion in this poll...

While I agree that using foreign case law to rationalize a decision on a court case is WRONG, this poll is not only "unscientific", it's only purpose is editorializing - something that we complain about when CNN etal do it in their polls.

Thats what makes the worldnetdaily polls some of the best around. The readership leans right, but thier polls give a wide range of options.

Didn't red the rest of the article, but is it not already the case that "foreign" law has been used to determine constitutionality? (ie. English Common Law, etc...).

Now, if the Justices are stating that "because the rest of the world doesn0t like the death penalaty, therefore it is unconstitutional . . .", hang um high!

It's shocking that this should even be posed as a legitimate question. In a few years, with out wonderfully public school educrats I suspect they will be clamoring for this. Then comes the one world government.
