Nope. The courts aren't going to see it that way. He's announcing in advance that he's planning to shoot a member of a foreign military. If I remember right, the actual border is not all that clearly marked there. He's blowing hard, of course, and is unlikely to actually carry out his threat. If he does, he may not even survive to face trial.

Show me the law that prohibits shooting and killing an invading foreign military force. You can't, because there isn't one.

The border is marked by the Rio Grande for Texas, although you could argue ignorance of geography. If the bad guys shoot first he has every right to defend himself.

Yes, the authorities could arrest him for PC reasons, but if it's a trial by his peers down in Texas, I don't see them convicting him if he's in the right.

It's certainly not a game. Our local law sheriff and the Border Patrol are doing the best they can with limited resources. The folks in DC could give a rat's hiney.

Ranch Rescue has concentrated their efforts around Douglas; Civil Homeland Defense and American Border Patrol usually work the Naco Corridor.

We have a military. We have law enforcement agencies. Theirs is the responsibility to defend our borders, not a bunch of trigger-happy "patriots."

Those of us who live here in Cochise County wish that it would work that way. Unfortunately, it doesn't. Our sheriff has only 75 deputies to handle a county the size of the state of Connecticutt. The few hundred Border Patrol agents are trying to control very rough country 24 hours a day. The terrain is against them -- lots of man-high scrub and a maze of dry washes that makes their job similar to trench warfare.

They managed to catch about 180,000 here last year, but they privately estimate that 500,000 to 700,000 got past them. That's just for 80 miles of border.

The Border Patrol will not see any reinforcements in manpower or equipment. Dubya's FY 2005 budget proposal cuts their funding by $130 million.

As far as Jack Foote getting arrested -- he would be only one of several hundred suspects and the authorities know it.

I feel that the citizens of your county have every right and should be able to use any means you feel fit to defend yourselfs against this invasion. Why do we have foreign military units regularly tresspassing on peoples property for the purpose of enforcing a group of drug smugglers? Bush isnt doing anything about it. Meanwhile if you were in their shoes you would just run away and abandon your home right? Otherwise you have to be at the mercy of a foreign military that can come on your property at anytime they wish.
