You're twisting this around.
Nobody is alleging that there was a sign posted or other notice given, or that the tape recording was done surreptitiously.
This appears to have been an inexcusable exercise of arbitrary and illegitimate power by a federal marshall. If it was done at the direct order of Justice Scalia, then both of them were wrong: Scalia for issuing an illegitimate directive, and the marshall for complying. This would be especially tragic as the matter involves a top member of the judicial branch, which is charged with enforcing the laws, not making them or executing them.
