According to a Republican staffer on the 9/11 commission, growing public and pundit outrage over commissioner Jamie Gorelick's failure to disclose the existence of a Justice Department memo, had chairman Gov. Tom Kean asking Gorelick yesterday morning if she would think about stepping aside.

"The word is she was asked whether she might consider it and she flat out shut him down," said the staffer. "We're in an extremely difficult spot on this."

Gorelick's conflict of interest came to light on Tuesday afternoon, when a newly declassified 1995 Justice Department memo written by her when she was serving as Deputy Attorney General was presented to the commission by Attorney General John Ashcroft during public testimony. The memo, which mandated policy that, as it turned out, made it almost impossible for counter-terrorism investigators to pursue the 9/11 plot before it unfolded, surprised Gorelick's fellow commissioners and staff because, staffers said, she never disclosed its existence to any of them.

Kean's quiet attempt to press the issue on Gorelick's situation comes at a time when there were mounting calls for the former Clinton political operative to step aside from not only the House Judiciary Committee chairman James Sensenbrenner but families of 9/11 victims concerned that the commission's report would be tainted by her presence.

Those families were also calling for Gorelick to be called before the committee to explain her role in devising a legal impediment that contributed to the intelligence and law enforcement failures to combat and prevent terrorist acts.

But according to former Clinton staffers, it's doubtful Gorelick will budge. "She's on that commission for a reason, and it isn't because of her brilliant legal mind," says a former DNC and Clinton White House staffer. "She's there to make sure Bush and his team look as bad as possible and to protect the Clintons and Reno."

It isn't just Gorelick who is now in hot water. Based on their remarks on Wednesday and Thursday, both Kean and fellow commissioner, former Sen. Slade Gorton are taking heat from 9/11 families for telling critics during TV interviews to stay "out of our business."

Those remarks came in response to questions about Gorelick's conflict of interest.

"We've got to get these guys out of the limelight," says the Republican 9/11 staffer. "Kean has enjoyed the media spotlight a little too much. Remember, most of these guys are has-beens. They haven't experienced this much attention in years. In a matter of two days they have managed to undo six months of good work that was done under the radar screen. A few more days of this and the commission's work will be tainted."

Jonah Goldberg from National Review Online, made the comment a couple of days that the 9/11 commission has 'jumped the shark.' I tend to agree. Nothing good is going to come out of this commission, it is just finger pointing. No solutions, just politicking. Time to end the charade.

That whole friggin' commission ought to go - it's turned into a sound-bite hunt for the DNC, because the Republicans on the panel have zero testicular fortitude, and are just out for face-time on the pundit circuit. It's pathetic.

It's just so frustrating. I want the republicans to be better than the Democrats, I just know that if it was a Republican who was in Gorelick's shoes, they would have resigned a long time ago under pressure. The dems just ignore it.It does get tiring.

Who is he trying to kid?
He could make it impossible for her to remain if he wanted to.
With the firestorm this has created, all Kean would have to
do is state publicly that she should, for the sake of the 911 families, resign.
He's pathetic, and so is the entire commission.

Kean's #1 goal is to further his son's political career in New Jersey. He's going to use the commission any way he can in order to help his son become New Jersey's governor in '05.

This commission is about to implode.

There is no escaping the fact that Gorelick should be testifying on why and for whom she wrote or signed off on that memo.

Furthermore, she is a stones throw away from obstruction of justice by not making the commission aware of the existence of this memo. The conflict of interest could not be more obvious.

Kean has a choice, kick Gorelick off the commission and force her to testify in public -- which may save what ever little credibility the commission has left -- or go down in history as the disgraced chairman of the kangaroo 9/11 commission. In a matter of days he'll be forced to do the first option.

Judging from this article, the commission staff may threaten resignations if Gorelick remains on the commission.

Well, let's be honest. She's been the pocket ace the Republicans have been holding in reserve. They knew what her role had been, and they saved it for the right moment.

There was a couple of weeks of buildup, setting up "the wall" as one of the major factors in allowing 9/11. Why do you think that was? Yeah, they were setting up this fall.

The commission *is* discredited now, and it was a brilliant play all around. As a bonus for them, the also ended Gorelick's career, whereever it may have been leading. But the main thing was to play out the commission.

Once again, Bush's team has been revealed to be rife with tactical political genius. From the 2000 Election on, they've run circles around the clowns running the Dem side. It's been most educational.

Gorelick blocked the FBI from apprehending two of the nineteen hijackers and preventing the attack the commission is investigating.

The commission has found the smoking gun and can go home.

Except for Gorelick who is remanded to a tall, burning building.

Probably the best thing that can happen is that she stays on the committee. It only amplifies the fact that the committee is political and tainted beyond repair.

By the way, Sensenbrenner is to be commended for doing the right thing and coming out with the call for resignation. Frist and Hastert should be out there pushing this. You don't see a huge chorus of Congressional Dems screaming in favor of Gorelick. Anything that draws more attention to Clinton's disgraceful and incompetent policies regarding the Terrorism problem is a sure loser to the donkeys.

I do hope you're right, because from what I've seen thus far, not one of these people have the character to do the right thing.

On this point I agree with you. However, IMHO it will not be their character that gets them to do the right thing. Instead, they will be FORCED to do the right thing because I predict there will be the threat of mass resignations of the commission's staff. The fact that we are reading this article seems to support my prediction.

Either congress OR the POTUS should be able to disbann this 911 Commission. A horrible CHARADE is being perpetrated on the American Public, and when the CHAIRMAN of this commission has the temerity and the stupidity to say {quote} "PEOPLE OUGHT TO STAY OUT OF OUR BUSINESS." {unquote}you know something is VERY WRONG. I sent the following email to Mr. Kean. It will probably do no good, but at least it makes me feel better for having sent it.

Mr. Kean:

With all due respect, it is not YOUR business, it is OUR business. You work FOR the American people, not the other way around.

I am surprised and deeply disappointed that you would so flippantly allow Ms. Gorelick to continue her conflict of interest in serving on the committee . She obviously should be testifying before the committee, rather than sitting in judgment on others.

This commission "may" have begin with good intentions, but it has become a laughing stock because of the conflict of interest and the political posturing of many of its members.

You, sir, need to stand up and be a man instead of a wimp. Ms. Gorelic absolutely must be removed from the commission or you lose what little credibility you have left.

Your commission was supposed to help us in the future, but is has rather been an attack machine on the past. In addition you are publishing our intelligence methods to the entire world. I suspect your commission has done thousands of times more harm than it has done good.

I call on you, Mr. Kean, to get together and be an American who is truly concerned about his country, rather than a spotlight seeker who is willing to allow truth to become a casualty to your pursuit of fame.

Daschle and Gebhart were responsible for her being on the commission. Wouldn't you know?

Also read a while back that her law firm is representing a Saudi "prince" who is a defendant in a lawsuit filed by some 9/11 family members of victims. I wonder if the outcome of this so-called fact-finding commission would have any effect on this client? If so, this would be another reason for her to go from member to witness.

Nice letter! If you really want to keep the pressure, I would call the commission at 202-331-4060. I did yesterday and got through. IMHO I would state pretty much what you wrote, but be extra polite about it -- it is much more effective than sounding like a screaming partisan hack. If the staff field enough of these polite phone calls they will invariably start to feel bad about this whole farce.
