Many, many years ago while working as a Deputy Sheriff for L.A. County on the high desert a unique thing happened. A 16 year old kid was driving home to the boondocks and had a confrontation with some dummy on the road.

The dummy went into "road rage" mode and threw his empty beer cans at the kids car. The kid contacted his dad via "C.B." radio and explained his predicament. Dad told his son just to come on home. He did with the dummy right on his bumper.

Dad was on the front porch with a rifle (bayonet attatched) and hollered for his son to get inside. The dummy had a club in his hand and started to approach dad who fired off a round or two as a warning into the air.

The dummy told dad he wasn't impressed and continued towards dad to confront him with his club. Dad did the "lunge" move and the bad guy got back into his car and told his wife to take him to the hospital. She stopped at a fast food place to call for an ambulance, but it wasn't needed.

Dad spent about an hour and a half with the Homocide detectives, and then his rifle, and bayonet were returned to him and he was sent home. Some times there is Justice in this world.

Close but wrong. It is permitted to use deadly force after dark to stop the commission of a variety of crimes or to retrieve your stolen property if you have no other way of getting it back.

So when they jumped in the truck to run them down... they shoulda grabbed the TV and brought that along...

Why do you live in Massachussets? It's as liberal as California (where I used to live). I left the state in 2002 and have been quite happy about my decision ever since.

Since the perps posed a threat to others (they did have assault rifles) a private citizen has a constitutional right to use deadly force to apprehend these fleeing felons. Garner v. Tennessee 471 U.S. 1 (1985) would provide the legal support for such a view.

You may be right. But doesn't this usually come down to a DA related decision regarding whether or not a jury will convict here? Does Texas usually convict on this sort of situation?

Can we rule out the possibility that the attackers were BATFE? Were there any pets killed? Did anyone check for large yellow lettering on their clothing? Were there any armored vehicles or snipers nearby?

It's pretty obvious that the so-called "homeowner" had chosen to arm himself sufficiently well to repel a powerful attack.

This TX law amazes me. In NM they have to have part of their body in your house before you can shoot them.

Yes --- it is so much nicer being able to leave the corpse outside the window versus dragging it through the window. That makes a mess inside your house.

This is real simple. After the homeowners chased them down, totaly legal, the invaders pointed guns at them and subsequently shot by the homeowners. I don't believe there is anything illegal about that.

In NM, a perp has to have part of his body inside your house before you can legally shoot him. I can't imagine this guy getting a free pass to kill someone who is in a field.

But this was in Texas, which is somewhat more good guy friendly and bad guy hostile.
