Testifying as the man accused of murdering your daughter looks on is something Teresa Vanderheiden doesn't wish on anybody.

"You try to keep your eyes focused on one thing," Vanderheiden said. "I remember looking at the clock a lot, thinking that would avoid it. But your eyes meet."

Anger flashed through Vanderheiden as -- in separate trials -- she came face to face with the men accused of murdering her 25-year-old daughter, Cyndi, in 1998.

"They're looking at you and as you look down and see them, you want to … " Vanderheiden, speaking from her Clements home, trailed off for a moment. "You just want to get rid of them."........

REDWOOD CITY, Calif. -- Testimony is set to resume Monday in Scott Peterson's double-murder trial.

Peterson's deceased wife's half-sister is scheduled to return to the witness stand.

Amy Rocha testified last week about the frantic scene at the Petersons' home on the day Laci Peterson was reported missing. ........

Peterson's Martha Defense

By CHRIS TAYLOR

Monday, Jun. 14, 2004

Martha Stewart was back in the legal spotlight last week — at another high-profile trial that has obsessed the media. As Scott Peterson went on trial for the murder of his pregnant wife Laci, the defense scored a surreal but key point by playing a videotape of the TV homemaker. Peterson had said that on the morning the prosecution says he killed Laci, she was watching Stewart talk about meringue. The Modesto, Calif., police department claimed no meringue was mentioned on Stewart's show that morning. But Peterson attorney Mark Geragos, in his opening statement, played the tape and showed otherwise.

That was just the first of many early embarrassments for the authorities. Geragos has displayed a talent for getting prosecution witnesses to point out inaccuracies in police reports. While prosecutors were trying to show that Laci was too tired to walk the family dog, as Peterson claims she was going to do the last time he saw her, they also inexplicably pointed out that she was able to go to a salon and a spa and buy about $100 worth of groceries that day. "It's a bit confusing what the prosecution is doing at this point," says former San Francisco district attorney Jim Hammer. ..........

If, God forbid, I were ever in this unthinkably horrible situation, I would beg the court to be as lenient as possible. I would ask that all charges be dismissed.

Failing that, I would appear at his subsequent parole hearings, asking that he be parolled ASAP. I would want him out of prison and on the streets by any legal means possible.

Because then he would be mine.

Here's a repost of mine from an earlier thread on a related topic:

I'm kind of shy of the death penalty. The problem, as I see it, is that I just don't like the possibility of government to pass laws and lay down the death penalty as a consequence to lawmaking gone wrong.

Now, don't get me wrong. I understand the need for killing a real bad man (or woman). It's just that giving the state the license to do so on the justification of their legal whoredom is troublesome.

As an alternative, I suggest that upon conviction of Murder One, the guilty is refered to the victim's surviving kin for thumbs up or down.

If thumbs up, the guilty spends the rest of his/her life in the Joint - no parole. My idea of prison is 6 days of work in 10 hour days. No TV, movies or phone. Three hots and a cot and adequate medical care but no weight rooms, special diets or heroic medicine. The prison population should sustain itself through industry.

If thumbs down, the family would select a member of it choosing to deliver the injection of the lethal cocktail.

In this way, all manner of justice would be served:

1) Society would be protected.
2) The guilty would pay for their crimes with their lives.
3) The wronged would have justice and, if they wish, revenge.
4) Lethal power would be restricted to the people.
5) Mercy would be an option for those of merciful inclination.
6) Life imprisonment would be assured if the death penalty were not invoked.
7) Life imprisonment might be worse than death for many criminals.
8) Society would be freed from the cost of prisoner support.
9) Revenuse might actually acrue from prison work and go towards aiding victims of crime.
10) The certainty of death or a lifetime of work would, in fact, deter crime.

Can anybody figure out why in the hell the prosecutor didn't have a map of the Modesto area on a board to help the jury and witnesses? Boggles the mind, now I'm getting concerned, perhaps prematurely.

"does anybody here know a good way to read the websleuths boards - they are difficult to follow..."

I read them on occasion. I think they are easier to read than the court tv boards and they have great posters. They usually have shorter threads, too! I just open the LP forum and read the threads with recent posts. The titles are a pretty good way to tell what they are about. Right now there are two good threads on what's new in transcripts.

Thanks RB! Is anyone else aggravated at some of the media coverage on this? They are bashing the prosecution and drooling over MG. We are only 2-3 days into this case! I believe that the prosecution feels that they must present this kind of case in a chronological fashion so that they don't lose the jury. I suppose if we get to the end of the trial we can perhaps criticize their strategy and tactics, but isn't it a bit premature at this point??? Isn't it premature to say that MG is winning because he can show a video of Martha Stewart talking about meringue? This is a murder trial not a speech contest. It's a marathon not a sprint. It's serious business not a laugh-it-up social event. I find it terribly offensive that Geragos is joking in the courtroom (based on reports). I've sat on two juries on far less serious matters and I don't recall any joking or much smiling in the courtroom. Anyone remember the Micheal Peterson case from last summer? Same kind of criticism of the prosectution and drooling over David Rudolf. Well, in the end, he was convicted so I think we need to just be patient. Sorry for the long post - I tend to be a bit verbose!

I know the media is concerned with the flash aspect but what concerns me is the degree of preparedness that the prosecutor has chosen. As I stated earlier, a map of the Modesto area is a must for these jurors. Forgetting to question Amy about the maternity pants kinda makes you wonder, too.

Let's just hope this jury has as wise a jury foreman as was in the Allen VanHouten-Blackthorne trial.

Jury Foreman, Brian Henry said during final deliberations:

'There are some pieces of the puzzle missing, but there is enough that the puzzle is together, and there is no reasonable doubt.'

I think they will put the map up as soon as they get to the point of Laci going missing...with regard to search that resulted.
Also, they DID question Amy about Laci's clothing on the 23rd...asking her if there was any question in her mind about what she was wearing. I'm thinking that he limited that questioning to see what MG has up his sleeve regarding his remark in his opening that Amy was not sure about what the pants looked like.

Don't get me wrong here. I thought the jurors would have been more involved in the case if Amy could have pointed to spots on a map regarding her shop, the golf course, Vella Farms, her home. You want to draw them in and create an understanding of the facts.

The maternity pants that were ordered from Motherhood Maternity (Peoples Exhibit#11)were forgotten about on the initial direct examination of Amy. Luckily, Geragos was hmming and hahing around long enough before starting his cross that Distaso was able to get back to Amy. He then questioned her about the type of material Laci was wearing on the 23rd compared to what was ordered from MM. I know they could have snuck that in somehow later but my point was preparedness.

I realize that presenting a case is a work in progress and I hope the prosecution took the off days to re-examine a couple of aspects of their presentation.

Perhaps the media think that he who drools the most, will get the infamous first interview with Geragos when the trial is over.

I agree with you that the joking around by Geragos, is completely out of line. I can't imagine how the Rochas feel at that moment.

That would be powerful.

Or what if the Mary Janes were found right there in the closet? Along with, say, every single other pair of shoes Laci owned? If so, then what would the defense say she was wearing on her feet when she "went to walk the dog"? (We begin to see why Matt Dalton or someone else may have planted those "slippers" or whatever they were, of Laci's, to be found "down the street"--remember all that?)

Fortunately, if he missed some stuff (I think so, too), he can always re-call whatever witness it was. He has until he rests his case to do this. And he will also have a similar (but not identical) chance to call the witnesses in his rebuttal case, if he chooses to have one.

Hi Dev. Maybe we can send him a clipboard with little boxes....then Distaso can check off the questions as he's asked them.

One thing so far that I'm not clear on is the Martha Stewart show.

On 12/23...the cleaning lady said that SP came home at 10:00am to pick up a Fed X envelope. Where was he? If he came home at 10am, he couldn't have seen any of the Martha Stewart show.

Sigh. I'm not seeing where he was on the 23rd in the morning. Are you?

I agree that they should be meticulously prepared and it would have been best to have a map, having Amy mark it as they did with the salon layout.
Sucks not having cameras in the courtroom....I noticed that during the opening that when Snott's taped calls were played, we did not get any of the dialogs. That will stink if we don't get those tapes transcribed. Will have to rely on reports from the media inside and I don't trust that myself.

The stuff on their is really intersesting. I heard some really interesting commentary this morning. Beth Karas and a former San Mateo Prosecutor for many years says that Geragos is really acting it up in the court room but in so doing he is walking right into Distaso's trap. Geragos is promising all sorts of things that he CANNOT DELIVER.

I'm reading some updates on CTV boards regarding MG's cross today...some are concerned about MG drilling the fact that Laci went walking in Carmel the week prior to her murder. Keeps asking if Laci stayed fit.
This does not concern me as there have been a few witnesses that have said that Laci was tired after her trip to Carmel, and the Doc reports that she fell ill during her walks. I hope the Pros counters with those points....

Exactly Julie. But don't get too worried yet. I listened to commentary this morning and Geragos is being set up. Distaso IS NOT STUPID nor is he UNPREPARED!! He WILL get his chance to lower the boom from which Mr. Hollywood will NOT recover. He absolutely MUST lay the detailed ground work first and YES, most of the coverage is troublesome to me.

RG the Prosecution always has the LAST say as well. They can rebutt plenty. I think as former long time San Mateo Prosecutor said this morning, Distaso is DELIBERTELY letting Geragos paint himself into corners. He thinks this is a deliberate strategy and I believe he will be able to fill in the blanks!!

MISFIT EXCLUSIVE!!!

An amazing inside source has just faxed us a copy of what prosecutor's have seized upon as Peterson's "To-Do" list, which enumerates the sinister tasks the murderer made for himself during his dastardly deeds:

1. Check haircut in mirror.
2. Pluck between brows
3. Charge cell phones
4. Empty internet cache on computer and delete history
5. Check haircut
6. Shave
7. Change clothes - stuff old ones in bottom of hamper
8. Pick up laundry soap and start the wash
9. Unwrap new lures
10. Throw out receipts for Big 5
11. Put umbrellas in car
12. Turn on Martha Stewart - 5 min
13 Write down what was on MS show - one word
14. Check haircut
15. Pick up some Red Bull
16. Check voice mail
17. Don't answer cell phone!
18. Check haircut
19. Cancel tee time at DR
20. Practice looking frantic and crying in mirror.

I don't think Scott quite checked off his To-Do list.

OMG Vel, that is fabulous. Also, the Prosecution has some other stuff that is FABULOUS. Just wait until they get the side scan sonar operator on!! They REALLY DID FIND LACI and they have a picture of her body apparently with a weight around the neck, one cinched around the waist and the feet I believe. The whole time she was there she was just washed in a channel about 30 feet deep and they have pictures of the drag marks where the tides pulled her back and forth. I just KNOW deep down that Geragos is gonna eat chit before this is over!!

Yes, you're right. I remember reading that the maid said he came in for one or two minutes around 10 on the 23rd. And, I can't remember the details, but I got the impression that that tidbit was not lost on the defense.

But there's still a question about the Martha show on the 24th. Supposedly she DID make a brief mention of meringue. WHEN in the show did she say it? If it was after 9:30, and if Scott claims to have seen it, then he has just contradicted his own story that he left the house at 9:30 that day.

For all I know, Martha might mention meringue in every one of her shows! I've never watched the show!

So, belatedly, I'm joining all of you who have been so upset that this case isn't televised. How I wish it were. I'd set the VCR every day and watch it in the evening, and also watch it during every free moment!

All shoes accounted for, as Jackie said, would be perfect.

Remember months ago, Matt Dalton (since fired by Geragos) claimed to have "found" some sort of slippers or flip-flops or other flimsy shoes, belonging to Laci, at a house down the street? That whole thing sounded like a total fix to me. Maybe all of Laci's shoes ARE present and accounted for, and maybe the defense knows this very well!
