Well, he must have requested the hearing, but he didn't seem surprised or upset that parole was denied....

I did a little research and discovered that the parole hearings are set well in advance. Berkowitz has not requested the 2 parole hearings he's had and it appears that he doesn't consider parole an option....

It may be mandatory. It may be the law that the prison board MUST give him a hearing.
