WASHINGTON - President Clinton (news - web sites)'s national security adviser, Sandy Berger, is the focus of a criminal investigation after admitting he removed highly classified terrorism documents from a secure reading room during preparations for the Sept. 11 commission hearings, The Associated Press has learned.

Berger's home and office were searched earlier this year by FBI (news - web sites) agents armed with warrants. Some drafts of a sensitive after-action report on the Clinton administration's handling of al-Qaida terror threats during the December 1999 millennium celebration are still missing.

Berger and his lawyer said Monday night he knowingly removed handwritten notes he had taken from classified anti-terror documents he reviewed at the National Archives by sticking them in his jacket and pants. He also inadvertently took copies of actual classified documents in a leather portfolio, they said.

"I deeply regret the sloppiness involved, but I had no intention of withholding documents from the commission, and to the contrary, to my knowledge, every document requested by the commission from the Clinton administration was produced," Berger said in a statement to the AP.

Berger served as Clinton's national security adviser for all of the president's second term and most recently has been informally advising Democratic presidential candidate John Kerry (news - web sites). Clinton asked Berger last year to review and select the administration documents that would be turned over to the commission.

The FBI searched Berger's home and office with warrants earlier this year after employees of the National Archives told agents they believed they witnessed Berger put documents into his clothing while reviewing sensitive Clinton administration papers, officials said.

When asked, Berger said he returned some of the classified documents, which he found in his office, and all of the handwritten notes he had taken from the secure room, but said he could not locate two or three copies of the highly classified millennium terror report.

i keep laughing my ass off thinking about hillary's initial reaction to this news. this is great, it really reminds people why they're never going to vote another clinton into the WH.

Wasn't Sandy Berger the one who was on White House logs as being the only official to enter Vince Foster's office before law enforcement officials arrived to seal his office? And weren't there Whitewater documents which were supposed to have been there, which never were found?

Berger as Clinton "garbageman"?

Apparently in October a National Archives Offical noticed him taking them .. then asked for them back

How the FBI got involved and who notified them, I'm not exactly sure .. but they searched his house and safe in January

Thanks for the link, "Just." It's certainly provocative. That article was written this past April. I don't have a handle on the Berger timeline, yet. But if I understand other posters on this thread correctly, then he stole the documents sometime last October. If Berger was in the National Archives looking at the same Millenium material Ashcroft testified about five months later, that seems to reinforce what Ashcroft was saying about something even more explosive than the Gorelick bombshell.

I am also wondering how he got caught. Were there hidden video-cams in the National Archives room which recorded him stuffing his pants? They must have some pretty hard evidence for him to admit right off the bat that he did it.

Wonder what kind of plea bargain/deal he will get.

with the most plausible being that someone caught Berger on a video tape giving himself a "package enhancement" with top secret documents.

That video alone would have 10 times the impact of Fahrenheit 911 if shown to the public

BS! He was the freaking National Security Adviser, he knows what is a classified document and which are originals. This is exactly their MO. They claim to be so damn smart but when they are caught they claim they didn't know something. Either they are brilliant and know more than anyone or they shouldn't be allowed near CLASSIFED INFORMATION.

Beginning to look like Berger was trying to alter the archive record to say Clinton didn't know about al Quada being in the US by hiding or changing the millennium bomber after action report.

So did Bush know? or did the Clinton administration just fail to pass it on to Bush.

Buried on Page 2: "Breuer said the Archives staff first raised concerns with Berger during an Oct. 2 review of documents that at least one copy of the post-millennium report he had reviewed earlier was missing. Berger was given a second copy that day, Breuer said. Officials familiar with the investigation said Archives staff specially marked the documents and when the new copy and others disappeared, Archives officials called Clinton attorney Bruce Lindsey to report the disappearance."

Why did the ARCHIVES call Bruce Lindsey?????????

It takes time to copy documents you are sure to need in a "sting" operation. You want to make sure you have the ones with the smoke still rising from the gun so to speak.
