WASHINGTON - President Clinton (news - web sites)'s national security adviser, Sandy Berger, is the focus of a criminal investigation after admitting he removed highly classified terrorism documents from a secure reading room during preparations for the Sept. 11 commission hearings, The Associated Press has learned.

Berger's home and office were searched earlier this year by FBI (news - web sites) agents armed with warrants. Some drafts of a sensitive after-action report on the Clinton administration's handling of al-Qaida terror threats during the December 1999 millennium celebration are still missing.

Berger and his lawyer said Monday night he knowingly removed handwritten notes he had taken from classified anti-terror documents he reviewed at the National Archives by sticking them in his jacket and pants. He also inadvertently took copies of actual classified documents in a leather portfolio, they said.

"I deeply regret the sloppiness involved, but I had no intention of withholding documents from the commission, and to the contrary, to my knowledge, every document requested by the commission from the Clinton administration was produced," Berger said in a statement to the AP.

Berger served as Clinton's national security adviser for all of the president's second term and most recently has been informally advising Democratic presidential candidate John Kerry (news - web sites). Clinton asked Berger last year to review and select the administration documents that would be turned over to the commission.

The FBI searched Berger's home and office with warrants earlier this year after employees of the National Archives told agents they believed they witnessed Berger put documents into his clothing while reviewing sensitive Clinton administration papers, officials said.

When asked, Berger said he returned some of the classified documents, which he found in his office, and all of the handwritten notes he had taken from the secure room, but said he could not locate two or three copies of the highly classified millennium terror report.

Clinton was interviewed by the "war slut" a week or so ago and when confronted with that confession Clinton gave to the Long Island Association in February 2002 said he must have "mispoken".

So they can do stuff accidentally and mispeak, but every time Bush does anything they don't like it's a lie.

Just an aside (perhaps), but Roger Clinton's visit to North Korea has always been high on my list of "I want the REAL story on what he was doing over there". I see it is on your list of doings in December 1999.

Berger was with Edwards until Kerry won the biggest part of the primaries, which was AFTER his house was searched; so, either Berger didn't tell Kerry what was going on, or Kerry has known this all along.

No, I think Gorelick was blindsided by Ashcroft. I believe all this happened in 2002, shortly after the DEMS started claiming "Bush knew"

The Bush Administration had to know that the Clinton Scum would try to blame him. My guess is that they "misunderestimated" George W. Bush once again

I believe they have the smoking gun!

According to Levin's article and Ashcroft's testimony, the hunt for the terrorists should have begun in FULL FORCE in 2000.

Secondly, the Millenial plot review information, according to Ashcroft, was not passed on to Pres. Bush's administration. The critical conclusion in that review was that there was a network of AQ operatives within the US that needed to be uprooted via aggressive enforcement of immigration laws and other legal tactics. THIS IS VERY DAMNING EVIDENCE FOLKS!

Thirdly, Burger was caught red handed -- hopefully on video tape! In due time I believe it will be proven that Gorelick tried to clean things up from within the commission.

Ashcroft's 9/11 testimony is the Rosetta stone, as far as I can tell it looks pretty bad for the dims.

I have the exact same question. And why, when Berger has known that he was caught red-handed, did he become part of the Kerry team? These are serious allegations, did he presume to have the outcome wired or did he think it all ended with his apology that he couldn't find the rest of the documents?

I have toured the National Archives, There are camera's everywhere, we were even told how anyone who comes in to review and document or documents, they have to request permission and it must be cleared. and the camera's watch closely. Berger was setup, that's why they let him leave with the documents, even though it's been reported that he was SEEN taking the documents.

LOL...1. He was sent there by Clinton to review what documents should be turned over to the commission for review.

2. He intentionally took certain documents.

3. He inadvertly discarded certain documents.

4. He had no intentions of with holding documents from the commission.

In Texas, we call this BULLSHIT. He was there to be sure of what the commission would review. Anybody who believes this bumbling idiot...I have some ocean front property in West Texas to sell.

I heard him change his tune from "I never said that" to "they misunderstood" (when learning there was a tape) and now admits HE may have misspoken. He is a man whose many talents never included the truth.

BTW off topic, does anyone recall Edward's wife saying she did not find anything said at the NY love fest offensive? Media has been reporting how Edwards is terribly disappointed with comments made by Whoopie but they're in a collective coma to resurrect the quote from his wife.

I didn't find anything of note in Berger's testimony.

As to the Lindsey story...Isn't it interesting that that story did not get much coverage? I thought at the time it was going to be a huge firestorm and then suddenly it was GONE! BUSH AWOL stories took over as the Bush-Bash story of the month. Very suspicious in light of Klepto-Berger.
