URGENT: Call Gov. Arnold Schwarzenegger Today To Oppose SB 1234!Please call Governor Schwarzenegger TODAY - 916-445-2841 - and urge him not to sign SB 1234. Tell him that you believe all crimes should be prosecuted to the full extent of the law but SB 1234 could be interpreted by courts to make religious speech a crime if the "victim" considers it a threat. It is very important that Gov. Schwarzenegger's phone rings today!
Consider what has happened in Canada since passing a "hate crimes" law that includes gender. It is no longer permissible in Canada to speak critically about homosexuality over the airwaves. Even the quoting Scriptures that condemn homosexuality can be illegal in Canada because of "hate crime" legislation.
In Sweden a pastor was sentenced to 30 days in jail for preaching a sermon in which he taught that homosexuality is wrong. This was the first case in which Sweden's "hate speech" law was enforced against a church. During court proceedings, the public prosecutor played a tape recording from the sermon. According to the church newspaper, he justified the arrest by saying, "One may have whatever religion one wishes, but [ the sermon ] is an attack on all fronts against homosexuals. Collecting Bible [ verses ] on this topic as he does make this hate speech."
Under SB 1234, individuals could claim that someone expressing their sincerely held beliefs presents an "intimidating" threat, punishable under the law. Even various forms of peaceful conduct, such as prayer vigils outside abortion clinics, could potentially be considered a "threat of force."
SB 1234 has now been passed to the Governor's desk for his signature. It is very important that you call him today - 916-445-2841 - and ask him not to sign SB 1234 into law.

A rather interesting contradiction:
Existing law provides that no person, whether or not acting under color of law, shall by force or threat of force, willfully injure, intimidate, interfere with, oppress, or threaten any other person in the free exercise or enjoyment of any right or privilege secured to him or her by the Constitution or laws of this state or by the Constitution or laws of the United States because of the other person's race, color, religion, ancestry, national origin, disability, gender, or sexual orientation, or because he/she perceives that the other person has one or more of those characteristics.
So if a gay doesn't like the words of a Christian against homosexuality - that person can feel threatened and charge that a hate crime was committed - but that action in turn deprives someone of the right of free speech because of their religion.
Fascinating.

I would agree for the most part but AIDS tends to be more specific to the male (such as it is) side of that community.

The US Supreme Court has already ruled before that "hate speech" is protected under the constitution.
We have a constitution that strongly protects speech, other countries do not.

Do you really think that the 9th Circuit will find this unconstitutional? Or, Sandra Day O'Connor, Kennedy, Souter, Breyer, Ginsburg, and Stevens? Just
who is going to strike down this law as unconstitutional if Schwarzenegger signs it?
I am really amazed by the number of folks in denial about the agenda that is clearly evident. 'Oh, surely it can't happen here!' This is a blatant step towards totalitarianism.
We'll no doubt be "reassured" by Country-Club RINOs that evrything will be OK because they'll try and make an exemption for religious groups. I wonder how many illegal aliens and other foreign nationals (who have no business voting, bu nonetheless vote in great number in every CA election) voted for the legislators who passed this outrage?

In the summary of the legislation linked to I didn't see any suggestion that speaking against homosexuality
per se would be criminalized. It does seem to expand the realm of "hate crimes" and tries to force the police to charge more people with them, so it's bad enough.
In the "arguments against" section some group made the argument that all crime has within it an element of hate; an idea to which the California legislature seems indifferent.
