When law suits involve "public officials" the slander and libel bar is raised VERY high. See New York Times v. Sullivan. As a result it is VERY rare for a "public figure" to win such a suit.

Given that, Kerry suing O'Neill is good. O'Neill suing Beckel is bad. But neither matters a whole lot, since nothing would be remotely resolved before the election -- and wouldn't matter after the election. This whole matter is going to be tried before a jury of 288 million, rather than a jury of 12.
