LEESBURG, Virginia (AP) -- As one of the world's most prolific spammers, Jeremy Jaynes pumped out at least 10 million e-mails a day with the help of 16 high-speed lines, the kind of Internet capacity a 1,000-employee company would need.
Jaynes' business was remarkably lucrative; prosecutors say he grossed up to $750,000 per month. If you have an e-mail account, chances are Jaynes tried to get your attention, pitching software, pornography and work-at-home schemes.
The eight-day trial that ended in his conviction this month shed light on the operations of a 30-year-old former purveyor of physical junk mail who worked with minimal assistance out of a nondescript house in Raleigh, North Carolina.
A state jury in Leesburg has recommended a nine-year prison term in the nation's first felony trial of spam purveyors. Sentencing is set for February.
During the trial, prosecutors focused on three products that Jaynes hawked: software that promises to clean computers of private information; a service for choosing penny stocks to invest in; and a "FedEx refund processor" that promised $75-an-hour work but did little more than give buyers access to a Web site of delinquent FedEx accounts.

Of course the reason he did it and the reason he made 3/4 mil per month is because PEOPLE ARE STUPID.
Make a policy, and teach your kids, your grand parents and you half wit siblings... NEVER BUY ANYTHING FROM SPAMMERS...
If you heard about it first via email DON'T BITE, even if you want the product (hint: you don't).

HERE IS MY SENTENCE FOR HIM...MAKE HIM REPLY TO EACH AND EVERY SPAM HE SENT OUT ... THE REPLIES COULD BE COMPLIED TO THE COURT AND NOT ACTUALLY DELIVERED TO THE ORIGINAL VICTIM... THEN HE COULD BE SET FREE.. I FIGURE HE WOULD DIE BEFORE HE EVER GOT OUT OF JAIL.
I hate spam also. But isn't there a free speech issue here somewhere? Does anybody worry about that?
He wasn't convicted of spam---he was convicted of fraud.
Free speech? This is harrassment and trespass. If the guy knocked on my door with some sales pitch and I asked him not to come back, I can have his arrested if he sows up again. But since this is the internet, he should be welcomed in my home any time? Using equipment that I paid for for my own convenience, not his?
Besides that, when I walk into a store and there's a rack of store sales papers by the door, I'm free to pick one up or not. Usually I don't because I'm at the store to get a particular item and don't care about anything else they're offering this week.
Why should this guy use a computer I paid for, a phone line I pay for and an internet service I pay for to rack up 750 grand a month? He's a parasite, putting it politely.
This is NOT a free speech issue. These people come into our homes uninvited and use equipment and services WE paid for to line thier own pockets. It is trespass as surely as anyone who would physically enter my home uninvited.
I bet that guy is hoping his fellow inmates never bought any of those penis enlargers he was selling. ;)
If they passed a law making spamming a capital crime punishable by feeding spammers alive to hungry sharks with lasers mounted on their heads, I would support it wholeheartedly.

Not even remotely. He peddles fraudulent schemes (fraud is not free speech). His mechanisms for perpetrating these frauds are theft of service and harassment, not to mention violation of all existing acceptable use policies.
He must be sitting in prison thinking "Why, oh why did I send all those "penis enlargement" and "herbal viagra" emails?"
Spam is no different than Junk Faxes. They cost the user money. Use the recievers equiptment and bandwidth.
Junk Mail is legal because all the expesenses of production and deliver are paid by the advertiser.

Let's see... a nine-year sentence was recommended, and the guy is worth $24 million. Sounds like a pretty good salary for those years.
yeah he did alright financially. that's why there has to be a financial penalty per spam email. make it non-cost effective for American-based. foreigners will have to be handled separately.
No. This is a property rights issue, not a free speech issue.
a) Republicans have to realize that being anti-spam is not being "anti-business,"
b) Just like faxes, there's a cost burden for receiving e-mail, and legislation similar to fax protection is needed,
c) The burden needs to be on the sender, not the recipient, making it opt-in, not opt-out,
d) Opt-out lists just provide lists of potential victims when a judicial stay is placed (see how that was done with "don't call" lists)--again meaning OPT-IN is required, not OPT-OUT,
e) Et cetera.
One of my biggest disappointments in W is that he just didn't "get it" with spam and his failed efforts against it.
Ok, is it considered spam sending someone information if you obtain an email directly from them?
Look at that guys pick, he doesn't neccessarily look sad, after 750K a month who would be? Even if he did it LEGALLY, from what he knows, he would have at least pulled off HALF of that income and still been sitting pretty!
