Sore Loser Kerry Mulls Lawsuit Against Swiftvet O'Neill
Newsmax ^ | 18 November 2004 | Carl Limbacher and NewsMax.com Staff

Posted on 11/18/2004 9:02:57 AM PST by NavySEAL F-16

Failed presidential candidate John Kerry is considering filing a libel suit against the leader of the group Swiftboat Veterans for Truth, John O'Neill, whose book "Unfit for Command" is credited with capsizing Kerry's Vietnam-based campaign.

"I don't know if they will actually go forward," a member of Kerry's inner circle told New York Post's PAGE SIX, edited by Richard Johnson. "But consideration is serious. If Kerry plans on running again in 2008 — and I'm hearing he will — it would make sense that he'd file the suit."

GREAT! Put Kerry under oath and ask him all sorts of questions. Get Kerry's diary and make it public, make his entire Navy file public. Please do it!

Actually, this would be fantastic. Kerry would actually have to get on the stand and testify and then be cross-examined. That would MAKE the pig have to speak, and to O'Neil's lawyers. I'll send Mr. O'Neil some $$$ to help pay his costs. You bet your lifesavers!!!

There will be no lawsuit. The swiftvets could get all the blocked documents in the discovery process. Kerry would be exposed then.

A lawsuit that would force Kerry to reveal his complete military record -- including the likely dishonorable discharge? Nice to dream about, but NOT A CHANCE.

He is only threatening the suit in a feeble attempt to gain some credibility.

If he were to actually do it, all his underwear will be hanging on the line. The discovery process will uncover all his dirty little secrets.

If sKerry thought he any chance of winning this type of suit he would have filed it already; the Swiftvets have been around for awhile. What a pathetic loser. I'm sure he was afraid that if he did sue, it would prove everything they said, and that would have tanked his campaign even worse.

The effort would only be to secure their silence, if possible, with a friendly bench or, failing that, to bleed the Swifties dry with legal costs. Timing will be what decides the day, because they won't file too far in advance and risk a contrary decision or chance for fund raising to meet legal costs.

Oscar Wilde made the same mistake. He actually beat the rap in criminal court, then decided he could win a civil case. Wrong. The civil case brought out testimony that was used against him in a subsequent criminal trial.
Kerry will threaten but won't follow through. But we already knew that about him.

make his entire Navy file public

That would be great! Lets see why Kerry refuses to make his military record public. Bush let his be public.

This is just typical demoncRAT stuff. Just like the demoncRAT hack who sued Drudge then had to pay Drudge a settlement. DemoncRATs use the courts to try and sway public opinion. After all, "why would Kerry sue for defamation if defamation didn't occur?!?" We will hear this over and over from the MSM.

#1 - Kerry has been lying all along about his military record, and John O'Neill would slaughter him on the witness stand like a sacraficial worm.

#2 - We'd all pay good money to the Swiftees to watch the show.

Never happen! But I'd pay good money (again) to see it!

Kerry thinking of running in 2008?

The Dems spent over 600,000,000 to see Kerry lose. They are not going to spend another half-billion to see him lose again. If they do they are bigger dopes than I thought.

Suing the Swifties? That would really get the Veterans' vote for the Dems.

Bump. Absolutely right take.

BRING IT ON!

Not a single mistake in the whole book, let alone falsehood, and this clown seriously believes he can challenge with a defamation action??

What an obstinate fool. He obviously STILL hasn't even read it. Or if he has, then Kerry has started believing his own shit. How incredibly typical of liberals...and sad. Constantly re-imagining life as he wished it to be with his cocky lies, he is now firmly detached from any semblance of reality. Must think he can use his $15 million stash to coerce a legal settlement by egregious levels of discovery.

Won't work, because as pointed out, that's a two-way street...and he has a lot more to hide.

I sincerely hope Kerry files a lawsuit. IF he does, then he will HAVE to release ALL of his military records as part of the discovery process. THEN it will be shown that O'neil was right about his accusations. Kerry will never file this suit, because then the truth will come out.

If you do not think a legal proceeding like this has the power to change the country, it's political and social course, it's image worldwide...just remember the Dreyfus case. Nuf said. I hope that Kerry decides to challenge these guys again. I hope that he does it in time to disgrace himself and his party yet again and cost them another national election. The world class selfishness of Bill Clinton was not something I thought to see surpassed in my lifetime. Here is Kerry out doing the most venal and self serving politician in my personal recollection.

Please, Mr. O'Neill, if you are reading this, allow me to assist in your defense gratis if he files a lawsuit. I am an attorney with almost 20 years experience, ten of them as an Air Force judge advocate. I have extensive trial experience (I was one of the Air Force's chief prosecuting attorneys) and I know the military regulatory game inside and out. You know, I'll sign on just to do paralegal work if that's what you need.

I cannot think of a case that would be more delightful to defend. Let me prep that part of the case about magic boonie hats and secret Christmas trips into Cambodia. I'm not greedy. Just give me that small part.

Sigh. Unfortunately, a lawsuit will never be filed. Kerry may be tall-tale teller on the order of Baron von Munchausen, but he isn't stupid. He's not about to put his military career under the scrutiny of a formal court proceeding.

He can't do it. His fully signed Form 180 would be subpoenaed, along with a full, adversarial investigation into the mysterious circumstances of his other than honorable discharge. And the Swiftees were proven right every time a document came out. This is publicity and nothing else.
