Well, I guess what I meant to say is, I'm surprised that the discretion is left to skip a Court Martial in such a severe circumstance. There should at least be a requirement for a formal finding of cause why a CM is not being convened.
But hey, I'm just a puffy civilian.
Here in San Diego we got hours of his showboating, he went to fox 6 on Saturday to set up his "stunt" also met with "antiwar" groups that were suppose to show up in support (they didn't) I heard he met them in a Jr. College class (Possible left wing instructor....Naw) currently he is guilty of missing a ship movement (not good in war time) but has 29 more days to figure out how to put himself back on the boat before AWOL charges are filed.
Hmm. What's that 'veterans.com' thing on his back? I can't make it out.
And Article 87, "Missing Movement."
It's up to the discretion of his CO if he is Court Martialed or sent to NJP: Non Judicial Punishment. Also, Pablo can exercise his right as the accused and request Court Martial in lieu of NJP.
Served in the USN.

I'm trying to remember, but my sea-going days are a little foggy. Aren't there special provisions regarding Court-martial vs. Art. 15 NJP that are dependent on whether or not the service member is assigned to a ship? I thought that being assigned to a ship meant that the service member cannot request a court-martial in lieu of Art. 15. I think the Govt. still reserves the right to choose court-martial if they so desire. Hoping there is a Freeper who can clarify.

It's none of your damned business. You joined the Navy, you volunteered, so do what you're told. No one said you got to pick and choose your war. After you get out of the brig, you need to be sent back to your Ecuadorian paradise where you belong.
I think it's all about sand. There's an abundance of sand in Iraq. Intel needs a LOT of sand to make those silicon wafers.
Well, what will most likely happen is he will be picked up (or turn himself in for punishment), put in the brig for a day or so to await transportation/escort back to his command - where his Commanding Officer will determine the course. He may be offered NJP, in leiu of a CM, but I wouldn't be surprised if his Captain wanted to wash his hands of the guy and just says "Court Martial the ******..."
He loves the attention and the media loves him.

I totally disagree. It costs the taxpayers, I'd just give him several 280 gr. lead injections at 1,600 fps.
He's only an E-4 after four and one half years? This boy just isn't very smart.
Give him credit for 'making a statement'? After his shipmates and their embarked Marines were already aboard (since 7AM)? I'd give him more credit if he faced them all dockside, and taken the inevitable thumping he deserved.
His is not to reason why. His is but to do or die.
